우리나라 수출입업자들의 Surrender B/L 이용 실태분석

An Analysis of the Actual Utilization Conditions of Surrender Bill of Lading among Korean Trade Parties

본 연구의 목적은 최근 변화하는 결제방식 하에서 선하증권이 가지는 권리증권으로서의 성격이 야기하는 불편함을 해소하기 위해 무역거래 당사자들 간에 관행적으로 사용되는 권리포기선하증권(Surrender Bill of Lading: SBL)을 기존의 선하증권 및 SBL과 동일한 효력과 기능을 가지는 해상화물운송장과의 비교를 통해 SBL을 정의하고 SBL 이용실태를 분석하여 올바른 무역거래서류의 사용을 권고하기 위함이다. 본 연구는 80개의 무역거래서류와 62개의 무역실무자를 대상으로 한 설문지를 바탕으로 SBL의 이용실태를 분석하였다. 분석 결과, 우리나라 수출입업자들의 SBL의 사용률은 높은 편이고, 주로 근거리 컨테이너 운송에서 많이 사용되고 있음을 확인하였다. 또한 관행에 따라 사용되고 있는 선하증권의 편법적인 형태의 SBL 이용에 따른 문제점 및 시사점을 제시하고, SBL의 향후 이용방안 및 개선점에 대하여 검토하였다.

Purpose : The purpose of this study is to recommend international trade parties to use correct transport document by verifying the definition of Surrender B/L through comparing with normal B/L and Sea Waybill(SWB), which has the same function and effectiveness of it, and analyzing the using behavior of international traders. Research design, data, methodology : This study takes field survey to analyze the actual utilization conditions of transport documents through analyzing 80 trade documents and 62 questionnaires to trade parties. Results : According to the survey, it is found that the utilization rate of Surrender B/L among Korean trade parties is around 33 percent, which shows relatively high utilization rate. It also finds that SBL is mainly used for short distance transaction. Conclusions : This study found that the utilization rate of Surrender B/L among Korean trade parties is high and SBL has been using in short distance container transaction. With respect to it, as this paper verifies the problems of Surrender B/L, such as an illegal form, improvement measures and practical implications are suggested.
