'학생인권과 교권'에 관한 몇 가지 '오해'풀어가기

Solving some 'misunderstandings' 'regarding students' human rights and educational authority - considering from a human rights perspective

본 연구는 현재 한국 사회의 청소년 자살, 학생인권과 교권의 위기, 그리고 학교폭력과 관련하여 언론에서 흔히 제기되는 주장들을 네 가지 의문문으로 정리하여 그 주장들이 보수적 시각에서 비롯되는'오해'일 수 있음을 인권의 시각에서 살펴보았다. 그 네 가지는'학생은 어려서 아직 인권이 없는가?','모두 학생인권조례 때문인가?','교권과 학생인권은 부딪힐 수밖에 없는가? 교사와 학생은 반대편이고 보수적 시각은 늘 교사 편인가?'그리고'학생인권조례는'좌파'교육감의 위험한 발상인가?'였다. 그 각각의 질문에 대해 본 연구는'꼭 그런 것만은 아니다'라며 인권적인 시각에서 논거를 제시해 보았다. 그리고 이러한'오해'들은, 학생을'미숙한 학습자'이며 훈육의 대상일 뿐이라고 보고 인권을 좌파적인 이념으로 보는, 전형적인'인권문맹'에서 비롯된다고 보았다. 아울러, 인권교육의 확산을 통하여 인권친화적 학교문화를 조성하는 것이 학교 안에서의 인권침해와 폭력의 궁극적인 해결책이라고 보았다.

This study explores hot issues regarding students and education, i.e., juvenile suicide and school violence, students' human rights and teachers' educational authority, and ideological conflicts ensuing from these controversial issues. Typical arguments easily found in the newspaper seem to take us to the following questions: 'Are students too young to have human rights?', 'Should 'the Ordinance of Human Rights for Students' be blamed for all the conflicts and controversies it has caused so far?', 'Do educational authority and students' human rights have nothing but to conflict each other, and does the conservative perspective of education field always work for the benefit of teachers?'and 'Was 'the Ordinance of Human Rights for Students' made by dangerous thought of a 'leftist' superintendent of education?' This study, then, attempts to show, from a human rights perspective, why 'not really' or 'not necessarily' are right answers to them. After all, it will be shown that it is neither right nor legitimate to regard students as 'immature learners' too young to enjoy human rights, and that advocacy of their human rights is beyond ideological dispute or attack. It further maintains that 'misunderstandings' as well as school violence are expected to disappear as school culture becomes more and more human-rights-friendly thanks to human rights education in school.
