한국 민주시민교육 법제의 발전방향에 관한 연구

The Developmental Directions for the Legal System of Civic Education in South Korea

본 연구는 한국 민주시민교육 법제의 현재 위치를 조망해 보고 그 문제점을 살펴봄으로써, 국민의 평생학습기회 확대를 위한 향후 발전 방향을 제시하는 것을 목적으로 한다. 민주시민교육의 법제화 필요성은 국민의 평생학습권의 실질적 보장을 위한 평생교육기관의 확대라는 측면에서 찾을 수 있다. 그러나 관련 법제인 교육기본법과 평생교육법은 민주시민교육에 대한 직접 적용이 힘들다는 현실적인 문제점이 있다.따라서 교육기본법 또는 평생교육법이 민주시민교육에 적용될 수 있도록 하기 위해서, 직접 명문 규정을 두는 것이 필요하다. 이러한 논의를 바탕으로, 한국의 민주시민교육 법제화와 관련된 향후 연구방향이 제시되었다.

This study aims to suggest developmental directions for the legal system of civic education in South Korea by exploring its current state and defects in order to expand citizens' opportunities for lifelong learning. The necessity of the legislation on civic education lies in establishing additional educational facilities in order to secure citizens' right to pursue lifelong learning. However, the problem is that the Framework Act on Education and the Lifelong Education Act cannot be applied to civic education directly. Therefore, it is necessary to make specific provisions in order for civic education to be covered by the Lifelong Education Act and the Framework Act on Education. Based on the above discussions, the future research directions for the legislation on civic education in South Korea were suggested.
