선상폭력의 형사법적 제문제

A Study on the criminal Issues related to the Violence on Board

최근까지 선상폭력의 실상은 크게 변함없이 지속되고 있다. 이와 같은 상황에서는 언제든지 페스카마호 사건과 같은 끔찍한 해상강력사건이 재발할 수 있다. 따라서 선상폭력에 대한 적절한 대응방안을 시급히 마련하여 그와 같은 재앙을 예방하여야 한다. 첫째, 선상폭력을 근절하기 위해서는 선상폭력에 대한 철저한 수사와 적절한 처벌이 지속적으로 이루어져야 한다. 그리고 증거수집이나 수사의 곤란을 해결하기 위해 CCTV설치, 순찰활동강화 등의 보완조치가 이루어져야 한다. 둘째, 선장이나 고급사관이 하급선원들을 지배하고 착취하도록 제도화된 현재의 생산수당분배방식을 개선하여야 한다. 즉 선박단위로 되어 있는 현재의 성과급제를 집단채산형태로 바꾸고, 선장이나 고급사관과 일반선원들 사이의 성과급분배비율을 합리적으로 재조정하여야 한다. 셋째, 어선선원의 근로조건, 고용계약, 복지 등에 관한 국제노동기구(ILO)의 협약을 비준하여 어선선원의 근로조건과 근로복지를 개선하여야 한다. 이와 같은 어선 선원의 근로복지를 개선함으로써 어선에서 발생하는 선상폭력을 근절하여야 한다. 넷째, 선상폭력의 심각성을 일반국민들에게 지속적으로 알리고, 모든 선원들을 대상으로 선상폭력에 대한 대처요령과 선상폭력에 따르는 법적 책임에 대한 교육을 실시하여야 한다. 이와 같은 개선조치들은 선상활동에서 착취구조의 해소와 협력관계의 형성에 기여할 것이며, 궁극적으로 선상폭력의 근절을 통해 페스카마호 사건과 같은 극단적 해상강력사건의 재발을 예방할 수 있을 것이다.

Until recently the Violence on Board has persisted. In this situation it is easy for maritime violent crimes like the Case of Pesca Mar to happen again. Accordingly it is an urgent matter to prepare appropriate measures to prevent such disasters from happening. First, strict investigations and punishment should be done for the eradication of the Violence on Board. Also to solve the difficulty issue of evidence collection or investigation such measures like installation of CCTVs, reinforcement of investigation, and so on should be taken. Second, the current way of distributing production bonus, which allows captains or ranking officers to rule over and exploit petty crewmen, should be improved to stop the above from happening. Namely we should alter the way of distributing from vessel units of distribution to a form of group profits, and should readjust the bonus ratio between chiefs and the sailors. Third, we should improve the working conditions and workfare by accepting ILO agreement which deals with such policies. Like this we should root out the violence on board by improving workfare of sailors. Fourth, we should keep on informing the citizens about such brutal violence that take place on board, and all crewmen should be educated on how to cope with such violence and the legal liability that follows. Such measurements would contribute to alleviation of exploitation structure and development of cooperative relationships, and by ultimately exterminating violence on board we should be able to prevent the recurrence of maritime violent crimes such as the Case of Pesca Mar.
