낙동강하구역의 효율적 보전을 위한 법제정비에 관한 연구

A Study on Improving the regulations for Effective management of Nakdong river estuary

낙동강하구는 철새도래지로서 뿐만 아니라 천혜의 자연환경을 갖춘 보존가치가 높은 곳이며, 이 때문에 다른 하구에 비해 많은 지역이 보전․보호구역으로 지정되었다. 그러나 대규모 지역개발 등에 의해 환경에 대한 압력이 가중되고 있기 때문에 시급한 보전방안이 필요하게 되었다. 현재 낙동강하구의 문제점은 첫째, 철새들의 쉼터이자 부산의 허파역할을 하고 있는 논습지가 개발의 논리로 인해 줄어든다는 것이고, 둘째, 관의 생태적 수변구역의 재정비로 인해 오히려 수변구역이 인간의 간섭이 더해져 수변생물이나 철새들에게는 위협요인으로 작용하고 있다는 것이다. 셋째, 부산시는 2001년 ‘부산광역시 낙동강하구 보전관리 조례’를 제정하였는데, 조례에는 하구와 관련된 사업과 계획은 입안단계에서부터 집행․사후관리까지 시민․전문가․시민단체의 참여가 이루어지도록 하여야 하나 부산시의 일방적인 정책관조로 인해 낙동강조례가 무용지물인 상태이다. 이러한 문제점에 대한 개선방안으로 첫째, 줄어드는 논습지 보전을 위한 구체적인 법률적 정비가 필요하며, 둘째, 하구보전의 한 방법으로 하구를 생태관광지로 지정을 위한 생태관광 법률의 정비가 필요하고, 친환경농업을 강제하여 환경도 살고 철새도 살고 사람도 같이 상생하는 방안을 제시하였다.

Nakdong river estuary is not only a place where migratory birds come over, but a preservation place blessed with the natural environment. Therefore, compared to other estuaries, many areas of the estuary were designated as conservation and preservation zones. Large-scale local development projects, however, have harmed the natural environment of the areas. Therefore, coming up with plans for preserving the estuary came to be required. The current problems of Nakdong river estuary are first that paddy fields and swamps, which are a habitate of migratory birds and play a role as a lung for Busan, have shrunk due to development projects, and secondly that the ecological reorganization of buffer zones by the governmental office is added into human beings' interference, giving threats to creatures and migratory birds living in the buffer zones, and thirdly that Busan Municipality established 'Ordinance of Preservation Management of Nakdong River Estuary in Busan' in 2001, under which projects and planning related to the estuary require citizens, experts, and civic groups to engage in all the relevant process ranging from design stage, to execution, and to post-management. Unfortunately, the unilateral policy contemplated by Busan Municipality made the ordinance useless and obstructive. Therefore, to solve the problems, what is needed is first to revise concrete laws to preserve the shrinking paddy fields and swamps, secondly to revise ecological tourism Act to designate the estuary as ecological tourist attraction. As a result, this study proposed a legislation plan of eco-friendly management for the coexistence of the natural environment, migratory birds and human beings in Nakdong River estuary.
