파나마 선박등기등록제도에 관한 고찰

A Study on the Ship Registration and Ship Mortgage Registration Procedures Under Panama Flag

편의치적제도는 경비 절감 및 자국의 규정을 회피하기 위하여 선박소유자의 국적과 다른 국가에 선박을 등록시키는 해운산업의 한 형태이다. 특히 파나마는 전세계 편의치적국 상선대의 가장 많은 부분을 차지하고 있다. 그러나 파나마 등기등록제도에 대한 실질적인 내용을 소개한 자료는 생각보다 많지 않다. 이에 파나마의 신조선 및 기존선 등기등록에 대한 사항, 등기등록의 말소, 3개월 특별등록 및 나용선 등록제도 등에 대한 자세한 내용을 소개하고자 한다. 이를 통하여 파나마의 선박등기등록과 관련된 문제에 대한 정보를 제공함으로써 미약하나마 실무적으로 도움이 되고자 한다.

Flag of convenience describes the business practice of registering a merchant ship in a sovereign state different from that of the ship's owners, and flying that state's civil ensign on the ship. Ships are registered under flags of convenience to reduce operating costs or avoid the regulations of the owner's country. Panama is the world’s largest registry country of flags of convenience in terms of merchantship fleets. However, there is a lack of information on Ship Registration and Ship Mortgage Registration under Panama Flag than we thought. Therefore this paper introduces and explains the general information and official tariffs for registration of newly built or second hand vessels, registration under new vessel name or ownership, special three months registration, bareboat charter registration and other assignments under Panama Flag. And registration procedures of mortgages and discharge of mortgages on Panama flag vessels are explained and applicable requirements are provided. This paper aims to provide general information about ship registration in Panama.
