남극조약체제상 환경보호제도에 관한 고찰

A Study on the Regime for the Protection on the Antarctic Environment in the Antarctic Treaty System

남극조약지역은 토착주민이 없을 뿐만 아니라 남빙양으로 둘러 싸여 지리적으로 고립됨으로써 지구의 오염원으로부터 격리되어 있고 인간의 영향을 거의 받아 오지 않았다. 그러나 20세기 후반 이후 급증된 과학적 활동, 관광, 탐험 등의 행동은 지구환경의 마지막 보루인 남극조약지역의 자연환경을 훼손시켜 가고 있다. 이러한 남극환경을 보호하기 위하여 남극조약체제는 남극조약지역내에서 발생하는 환경오염 또는 환경위해행위에 대응하여 지속적으로 법제도를 발전시켜오고 있다. 또한, 남극조약체제 이외에도 남극해양환경보호에 대해서는 유엔해양법협약상 해양환경보호제도가 일반적으로 적용가능한 것으로 판단되고 있다. 이러한 배경 하에서 본 논문은 남극조약체제에서 남극환경 보호 및 보전을 위하여 취하고 있는 제도적 조치에 대하여 1991년 남극환경보호의정서 채택 이전과 이후로 나누어 분석하였다. 또한, 남극조약지역내 해양환경보호와 관련된 유엔해양법협약상 해양환경보호제도의 적용가능성과 적용상 발생할 수 있는 문제점을 살펴본 후 우리나라의 향후 대응방향을 제시하였다.

Due to non-indigenous population and geographical isolation, the Antarctic Treaty area was relatively free from human impacts and various pollutants. However, rapidly increased human activities including scientific research, tourism and expeditions in the Antarctic Treaty area have caused serious impacts on the Antarctic environment since the late 20th century. In response to the environmental threat, the international community has developed the various environmental measures and treaties under the Antarctic Treaty System. Furthermore, the 1982 United Nations Convention on the Law of the Sea(hereinafter 'the 1982 LOS Convention') is deemed as an important international instrument to protect the Antarctic marine environment. With the recognition of the global needs to protect the Antarctic environment and bearing in mind the adverse impact of human activities in the Antarctic Treaty area, this paper examines the environment protection regime under the Antarctic Treaty System, reviews the availability of the 1982 LOS Convention for the protection of the Antarctic marine environment, and suggests some recommendations for the future works of the Korean government in relation to the protection of the Antarctic environment.
