일본 도선사 면허제도에 관한 연구

A Study on the License System for Pilot in Japan

도선이란 일정한 수역, 즉, 도선구를 항행하는 선박에 도선사가 승선하여 선박을 안전하고 신속하게 인도하는 것을 말하며, 그것을 제도화한 것이 도선제도이다. 도선사란 강, 항로 또는 수로, 또는 항만으로부터 또는 항만안에서 이동하는 선박을 향도할 목적으로 특정 장소에서 선박에 승선하는 사람을 말한다. 이 도선제도가 원활하게 기능하는 것에 의하여, 그 수역의 선박교통의 안전이 확보되고, 선박운항의 능률이 증진된다. 세계 각국은 자국의 실정에 맞는 도선제도를 관련 법령을 제정하여 운영하고 있다. 도선제도와 관련하여 중요한 사항은 유능한 도선사를 선발할 수 면허와 시험, 도선사 양성과 교육, 강제도선을 포함한 도선구, 및 도선서비스 제공과 도선료를 포함한 도선조직에 관한 것이다. 일본은 2006년 도선사 선발 제도와 도선사양성시설의 설치 및 도선조직에 일대 전환을 가져온 도선법 개정이 있었다. 우리나라는 지정학적 특성상 해상운송이 우리나라 무역과 국민경제에 미치는 영향은 실로 지대하며, 일선 항만에서 입출항하는 선박의 안전항행을 책임지는 도선업무의 중요성 또한 매우 크다. 도선제도도 그 제도의 본연의 이상적인 자세와 상태에 가장 적합하게 시행되어야 함은 물론이다. 따라서 이 논문은 일본 도선제도 중에서 도선사 진입을 위한 시험의 응시자격과 면허 요건을 중심으로 우리나라의 경우와 비교법학적으로 연구하여 우리나라에서의 개선방안을 제시하는 것을 연구 목적으로 한다.

A pilotage is that any person not belong to a ship conducts her navigating at pilotage districts. The pilotage system is which this pilotage is institutionalized. A pilot is a person taken on board at particular place for the purpose of conducting a ship through a river, road or channel or from or into a port. Such conduct is confined to the process of navigation. Each country stipulates pilotage system which reflect its own situation to promote the safety of marine traffic and the efficiency of port through pilotage act. The important facts concerning the pilotage system are qualifications of persons eligible for pilot examinations, granting of pilotage licenses and promotion, method of employing pilot apprentices candidate system, pilotage districts including compulsory pilotage, pilotage organization including pilotage service, etc. In 2006, The Pilotage Act in Japan introduced new recruiting system of pilots and establishment of training center for pilot. Sea transportation is a potent influence to the trade and the national economy in our country, also the pilotage system is very important. This study aims to suggest the improvement of the licence system for pilot in Korea through the study on the same system in Japan.
