어촌관광관련 법률의 개선에 관한 연구

A Study on Improving the regulations for Fishing Village Tourism

어촌관광은 어업의 경쟁력 약화로 인하여 낮은 수준에 머물러 있는 어촌 주민의 소득증대를 위한 정책적인 요구와 주5일 근무제 실시와 국민소득의 증대로 발생한 대안관광에 대한 수요증가가 결합되어 생겨난 관광형태이다. 이러한 어촌활성화를 위한 어촌관광 정책은 2001년부터 추진된 어촌체험마을 조성사업과 어촌종합개발사업으로 구체화되어 어촌의 생활환경정비 및 어가소득증대에 부응하고 있다. 어촌관광과 관련된 내용은 10여개의 법률에 산재되어 있다. 2007년「도시와 농어촌간의교류촉진에관한법률」이 제정되기 전까지는「어촌어항법」과「농어촌정비법」에 의해 어촌관광 사업이 진행되어왔다. 지금도 어촌관광은 이 두 법률을 근거로 하여 이루어지고 있으나 2007년도에 제정된「도시와농어촌간의 교류촉진에관한법률」에서 어촌관광에 관한 내용을 중점적으로 다루고 있어 법률적용의 중복성이 문제가 될 수 있다. 법률의 중복은 사업의 중첩성과 그로인한 예산의 낭비 문제가 발생될 수 있다. 따라서 이 논문은 어촌관광과 관련된 법률들의 문제점들을 도출하고 그에 대한 개선방안을 제시하고자 한다.

The fishing village tourism policy to facilitate a fishing village was actualized in the types of the project to build a town of fishing village experience and the fishing village complex development project, living up to the living environment improvement of a fishing village and an increase in incomes of fishing families. Contents about fishing village tourism are found in as many as 10 laws. Fishing village tourism was controlled by Fishing Villages and Fishery Harbors Act and Rearrangement of Agricultural and Fishing Villages Act before Promotion of Mutual Exchange between Cities and Agricultural or Fishing Villages Act was established in 2007. Fishing village tourism is still based on the two laws so far, but it is also controlled by Promotion of Mutual Exchange between Cities and Agricultural or Fishing Villages Act so that duplication of legal application can occur. In particular, the legal duplication can cause overlapped projects and consequently lead to budget duplication and waste. Therefore, this thesis is intended to propose a plan to improve the laws relating to fishing village tourism.
