A Study on the Territorial Issues of Islands between China and Japan -Focused on the Time of the Second World War's End-

조어도를 둘러싼 중국과 일본의 영유권 분쟁은 독도문제와의 유사성 때문에 국내에서도 많은 연구가 이루어 졌으며, 현재도 진행 중이다. 특히 2차 세계대전 전후로 발생한 일련의 사건들이 이 두 영토문제의 주요 원인으로 지목되고 있다. 이와 같은 상황에서 같은 역사적 배경을 공유하는 두 지역의 상황을 국제법적으로 비교분석하는 것은 문제의 해결을 위한 실마리를 찾기 위해 필수적이라 할 것이다. 종전 후 그 처리과정에서 영토문제가 발생했다고 보는 견해에 따르면 당시 이 지역에 영향력을 행사했던 세력 즉, 미국을 중심으로 한 연합군의 판단이 영토문제 해결을 위한 중요한 근거로써 작용할 수 있다. 이 견해는 영토문제에 관한 국제법원의 판결기준에 근거하고 있다. 이 논문에서는 이러한 견해를 포함한 도서영유권에 관한 국제법원의 판결원칙을 살펴보고, 위 두 지역의 사례와 비교분석한다. 결론적으로 이 지역들의 도서영유권 문제는 제2차 세계대전 종료시점을 중심으로 연구되어야 할 것이다.

The territorial issues of Diao-yu Dao/Senkaku Islands between China and Japan have been extensively studied in Korea because it is similar to Dokdo problem. Especially the sequence of events during and after the Second World War are being blamed for the two territorial problems. In this situation, it is necessary the international legal comparative analysis of the two area in the same historical background for the solution of problems. According to the opinion which is the process of postwar cause territorial problems, the decision of ruling power, the Allied Powers and the United States, could be the important basis for solving territorial problem. This opinion is based on the criteria for the decision of international court. In the paper, the writer analyse criteria for the decision of international court about the opinion and compare the criteria with these two territorial problems. The writer suggest that the problem of the territorial issues of Islands should be focused on the time of the Second World War's End in conclusion.
