A Study on the Way to protect the Potential Licensee who infringes SEP

The world's major enterprises are focusing on securing SEP(Standard Essential Patent). The reason is that enterprises which secured SEP can have their dominant market share in the related field and can receive lots of royalty from enterprises which want to use that SEP(potential licensee). On the other hand, the potential licensee faces with the problem that the license negotiation for using SEP breaks down. When the potential licensee uses it without the license for using the SEP, the owner of the SEP takes action of injunction against the potential licensee. For this reason, the potential licensee is having difficulty in entering into the market of the related field and finally surrendering initiatives of the related field. The main reason for making this situation is that whether or not the owner of the SEP can take action of injunction against the potential licensee is uncertain. Naturally, it is necessary that the patentee can take action of injunction against a person who infringes the patent. However, when the potential licensee negotiated for the license with the owner of the SEP that declared FRAND terms but the negotiation broke down, and after that, the potential licensee used the SEP without the patentee's permission, there is the problem on whether the owner of the SEP can take action of injunction against the potential licensee or not. This paper would like to inspect each nation court' tendency whether taking action of injunction abuses SEP or not, when the owner of the SEP that declared FRAND terms takes action of injunction. In addition, this paper would like to coincide with the purpose of the Patent Act(to accelerate the development of technology through the protection, encouragement, promotion, and utilization of inventions, and thereby contribute to the development of industry) by protecting the potential licensee through the Patent Act' revised version allowing a compulsory license.
