과학적 증거의 무결성 보장을 위한 증거법적 개선방안 - DNA정보수집에서의 보관의 연속성과 무결성을 중심으로 -

A Suggestion on the Improvement in Terms of Evidence Law to Ensure the Integrity of the Scientific Evidences - With a focus on the integrity and continuity in the practices from DNA collection to its storage -

과학적 증거가 증거능력 또는 증명력에서 어떠한 법적 평가를 받는가에 관하여 논의하기 전에 선결되어야 할 문제가 있다. 바로 과학적 증거가 증거능력을 인정받는 전제조건으로서의 증거의 무결성 보장이다. 과학적 증거의 무결성에 초점을 맞추는 이유는 무결성의 보장이 직접적으로 증거능력의 기초되는 사실로써 증거능력 인정유무에 직접적으로 영향을 미치기 때문이다. 과거에는 과학적 증거방법에 의하여 증명되는 적극적 사실들에 관한 증거능력과 증명력에 초점이 맞추어 졌다면, 다시 이에 관한 선결문제로써 무결성 보장을 위한 법적 접근이 이루어 져야 할 것이다. 이는 특히 최근 과학적 증거의 보관상 미비 또는 허점으로 인하여 증거가 오염되거나 관리과정에서 교체되거나 조작됨으로 인하여 재판에 영향을 미치게 된 몇 가지 국내외적인 사례들이 발생하였다는 점에서 더욱 그 중요성이 각인되었다고 할 수 있다. 이러한 과학적 증거의 무결성 문제는 디지털 포렌식 영역에서는 이미 기술적․법적 영역에서 많은 연구와 성과를 도출해 내었지만, 상대적으로 유전자분석의 영역에서는 이에 미치지 못하는 경향이 있는 듯 보인다. 따라서 본 논문에서는 우선 과학적 증거의 활용의 전제조건을 살펴보고(Ⅱ), 무결성 보장을 위한 증거법적 논의를 특히 유전자분석을 중심으로 논의한 후에(Ⅲ), 과학적 증거분야를 통괄하여 무결성을 보장할 수 있는 통일된 증거법적 개선이 가능한지를 검토․제시해 보고자 한다(Ⅳ).

Scientific collection of material evidences has gained attention in terms of the utilization and importance as it produce evidences with persuasive advantages to reinforce the credibility of the objective relations and the facts in criminal processes in the narrow sense. Therefore, for decades, studies has been going on the evidential efficacy and the status as viable evidences of the scientific evidences. But, there are some problems that need to be addressed before we examine how these scientific evidences are evaluated in legal senses in terms of their status as evidences and evidential efficacy. That is, the guarantee of integrity of the evidences as a premise of those evidences to be accepted as viable evidences at all. The reason we focus on the integrity of the scientific evidences is that the guarantee of the integrity is the foundation of the evidential efficacy, which directly affects whether such an evidences is recognized to have the capability of evidences as a fact. If the focus was on the evidential efficacy and their capability of proving the fact of the active facts that are proven by scientific means, as a premise, another legal approach should be made to ensure the integrity of them. The reason why this is important today is that there have been a few cases where the integrity of the evidences is compromised due to lack of caution in storage and resulted in contamination, or the evidences replaces or manipulated to affect the result of the trial. The problem of integrity of the scientific evidences, in terms of the digital forensic, has seen a number of studies and results in the technical and legal domain. But such is still not the case with the genetic analysis. Therefore, in this study, we will examine the premise of the utilization of the scientific evidences (II), discuss the ensuring of the integrity in terms of the evidential law with a focus on the genetic analysis (III), and see if the evidential improvement in a unified form to ensure the integrity of the scientific evidences is possible and suggest such a solution if any.
