The Meaning of the Responsibility to Protect Theory and Its Development Direction

보호책임 이론은 주권국가가 대규모의 심각한 인권침해 사태로부터 주민을 보호하는 데 실패할 경우, 국제공동체가 이 사태를 해결할 수 있는 방안을 제시하고 있다.보호책임의 개념과 내용은 2001년 「ICISS보고서」에서 구체화되었으며, 2005년 「세계정상회의 결과물」을 통해 150여개 국가로부터 승인을 받았다. 이 논문은 보호책임 이론을 둘러싼 논란을 분석하고 이를 바탕으로 이 이론의 발전방향을 검토하였다.이를 위해 먼저, 인도적 개입,무력충돌시 민간인 보호,유엔 평화유지활동 등 보호책임과 유사한 개념을 비교하여,보호책임 이론의 독자성을 살펴보았다.두 번째 부분에서는 보호책임에 대한 여러 가지 논란 중에서 가장 많이 지적되는 두 가지 논란을 검토해 보았다.하나는 보호책임을 이행할 적극적 의무가 국가에게 있는지 여부이고, 다른 하나는 안전보장이사회의 승인 없이도 국가 또는 지역집단이 보호책임을 이행할 수 있는지에 관한 것이다. 마지막으로 세 번째 부분에서는 보호책임의 발전방향을 검토하였다.이를 위해 먼저, 유엔 개혁과 지역기구의 역할 증대를 함께 시도하는 투 트랙 전략을 분석해 보고,그 다음으로 예방책임을 보호책임의 핵심 역할로 강조하는 전략을 살펴보았다.

The international community cannot afford to remain the failure of State to protect their populations from mass atrocities, the Responsibility to Protect (R2P) being the most compelling indication thereof. The principles and contents of the R2P were detailed in the 2001 report of the ICISS and they endorsement in 2005 by more than 150 heads of states in the 2005 World Summit Outcome. First part of the article studied the concept and characteristics of the R2P, after comparing similar concepts from humanitarian intervention, the protection of civilians in Armed Conflict, UN peacekeeping operations. The second part of the article examined two most controversial issues on the R2P. First one is whether States has an affirmative obligation to implement R2P. Second one is whether State or regional organizations could implement the R2P without authorization from UN Security Council. The third and final part of the paper reviewed directions of development of the R2P. For this, the article first analysed two-track strategy which attempts to strengthen responsibility of both reforms and regional organizations. Then it examined responsibility of prevention as a core responsibility of R2P.
