교정의료인권의 선행연구에 대한 비판론

The Investigation regarding the existing studies of the correctional medical human right for prisoners

교정의료는 수용자의 인권복지와 교정공공재의 생산에서 중요한 역할을 한다.그러나 우리나라의 교정의료는 여러 가지 측면에서 문제점이 노정되어 왔다.이러한 교정의료의 문제점에 관한 기존의 선행연구들의 내용은 거의가 행정적, 법학적,생의학적 모델에 입각하고 있다. 따라서 본 논문에서는 교정의료에 관한 선행연구들의 문제점과 한계를 지적하고 인문사회의료,회복적 교정의료,통합적 교정의료 등 기존 선행연구들에서는 전혀 언급되지 않았던 독창적인 측면들을 제시하였다. 기존 선행연구들에 대한 비판을 통하여 교정의료의 새로운 근본적 인 방향을 경로혁신적으로 강조하였다. 이것이 기존의 선행연구들과 결정적으로 다른 점이며 이 논문의 존재이유이다.

The imporance of keeping good correctional medical treatment for prisoners cannot be overemphasized viewed in human right social welfare for prisoners and producing correctional welfare pubilic service for prisoners. But, korean correctional medical treatment for prisoners has many problems. Over the past few decades, the existing studies of the problem in the correctional medical treatment for prisoners in korea have been almost based on the administrative aspect, legal aspect, and bio-medical model. There has almost been no study that tried to focused on the interdisciplinary aspect about the correctional medical treatment for prisoners in korea. Therefore, in this article, I would like to explore new approach which the existing studies passed over about the problem of the correctional medical treatment for prisoners, including ocial medical treatment, intergrate correctional medical treatment, restorative correctional medical treatment and so on after taking up the limit of the existing studies. I would like to emphasize new aspects of the correctional medical treatment through criticizing the existing studies. My research is different from existing studies in that point.
