민간조사제도 도입에 따른 지적재산보호 활용방안

2000년대에 들어와 많은 지적재산물의 재산화로서의 인정은 오늘날에는 손에 잡히고 만질 수 있는 구체적인 물건 뿐 만 아니라 지식, 생각을 통해서 만들어진 것들이 커다란 경제적 가치를 부여하여 지적창작물에 대한 재산권을 행사할 수 있도록 하였다. 지적재산권은 기존의 재산권과 달리 물리적으로 유형화되어 있지 않으며, 가치가 명확하게 측정되어 있지 않기 때문에, 도용하는 것이 용이하고, 불법으로 도용되기 쉬운 특성으로 인하여 재산 가치를 온전히 보전 받지 못하고 있다. 특히, 1990년대 말부터 확장되기 시작한 인터넷의 활성화는 많은 창작물을 허가 없이 무분별하게 활용하게 하는 개기가 되었다. 특히, 우리나라의 경우 1970년대 경제성장을 위하여 지적재산권에 대한 관리를 소홀히 한 결과, 무분별한 복제품의 생산, 무분별한 창작물의 도용으로 인하여 국가에 대한 신뢰도를 떨어뜨리고, 창작활동을 방해하여 문화적 콘텐츠의 재생산에 악영향을 미치는 요인이 되었다. 이러한 문제에 대하여 이 연구에서는 국내의 도입이 시급한 민간조사제도를 활용한 지적재산권 보호방안을 제시하였다. 국내 도입이 유력한 민간조사제도는 경찰 및 검찰과 같은 공경비와 반대되는 개념으로써, 민간인이 특정인에게 재화를 지급받고 치안서비스를 제공하는 것으로서 지금까지 행해져왔던 민간경비의 한 영역으로서, 기존 민간경비가 예방적 차원의 활동이 전부였다면, 민간조사제도는 사후 피해회복 및 조사활동을 통한 문제점 예방과 같은 복합적인 형태의 치안서비스가 이뤄지는 것이 특징이다. 따라서, 지적재산권과 같이 비 유형적인 형태의 재산권을 보호하고, 유출 시 재산의 회복을 위하여 민간조사제도를 이 연구를 통하여 제안해 보았다.
