성전환증의 규범적 판단 : 병역법을 중심으로

A Study on Normative judgment of the Transsexualism : Focusing on the MILITARY SERVICE ACT

본 연구에서는 성전환증의 증상과 특징을 통해 정신의학적 진단과정과 임상적 판단자료에 대하여 정신의학적 고찰을 하고, 병역법상 병역처분을 위한 신체등위 판단의 체계를 살펴본 후, 성전환증의 병역판정에 대한 문제점을 논의하고 그에 대한 개선방안을 제시하였다. 자신의 생물학적 성에 지속적으로 불편감을 느끼는 성전환증은 ICD(International Classification of Diseases)-10과 DSM(Diagnostic and Statistical Manual of Mental Disorder)-5에 의하여 국제적으로 정신장애로 분류되고, 한국에서도 한국표준질병ㆍ사인분류(통계청고시 제2010-150호)에 의하여 통계적 현황이 유지되는 정신 및 행동장애이다. 성전환증은 발병 원인을 규명하는 신체의학과는 달리 증상을 중심으로 임상적 기술에 의존하여 장애로 볼 수 있는지에 여부에 대하여 진단하게 되고 이를 위해 병력청취와 정신상태검사, 심리검사 등이 판단 자료로 활용된다. 병역은 징병검사에 의해 신체등위의 판정에 따라 현역, 예비역, 보충역, 제1국민역, 제2국민역으로 구분되고, 징병신체검사에서는 일반적 신체검사와 심리검사를 실시하여 질병 또는 심신장애의 평가 기준에 따라 성주체성장애가 있는 자는 현역병입영 대상자, 보충역, 제2국민역, 재신체검사 대상자로 병역처분이 가능하다. 이에 대한 실효성을 담보하기 위해 신체등위 판정에서 병역감면을 목적으로 속임수를 썼다고 인정할 만한 사유로 병역면탈 혐의가 인정되면 형사처벌을 받고 병역처분이 변경된다. 병역법상 성전환증에 대한 병역판정에 있어서 성전환증에 대한 규범적 지위가 모 호하고, 실질적으로 병역판정을 위한 징병검사에서 장기간 진단 과정을 요하는 성전환증을 판단하기에는 한계가 있으며, 최종적 병역판정을 위해 성전환증 진단과 관련된 사실관계 확인을 위한 제도가 미비한 점은 문제점으로 보여 진다. 이에 대한 개선 방안은 성전환증 판정에 ‘심신장애’의 관점에서 ‘행정감정인’ 제도를 도입하여 성전환증의 정도 판단에 대한 규범적 의견을 제시하는 방안을 제시하였고, 성전환증을 주장하는 징병검사대상자에게 Full battery검사를 실시하고 심리평가보고서를 작성하여 병역처분을 위한 참고자료로 활용할 바를 모색하였다. 또한 성전환증의 병역판정 과정에서 필요적 검증시스템 도입을 제안하였다.

The purpose of this study is to review psychiatry’s investigation for diagnostic process and judgment of transsexualism, look at physical class for military service following Military Service Act, discuss problems of military service judgment and indicate improvement scheme of that issues. Transsexualism is classified psychic disorder internationally as ICD(International Classification of Diseases)-10 and DSM(Diagnostic and Statistical Manual of Mental Disorder)-5, that feel uncomfortable for biological sex. It is psychic and behavior disorder to maintain statistical present situation by Korea Standard Disease and the Cause of Death in Korea. Military service is sort out active service, the first reserve, reservist duty, the first national duty, and the second national duty according to judgment of physical examination and medical check up for conscription. The person have the character of transsexualism can be taken administrative measures such as active service, reservist duty, the first national duty, the second national duty and re-examination of physical and medical test. To secure practical effect of physical examination for transsexualism, they receive criminal punishment and alter military service disposal. It is some problem to judge transsexualism of military medical check up for conscription because normative states of Military Service Act is vague and the confirmation of fact is limited. The countermeasure is to suggest normative opinion to judge the standard of transsexualism of introduction the concept for “the mentally and physically handicapped” and “administrative expert estimation system”, and grope to utilize mentality assessment report through Full battery test to insist oneself saying transsexualism. It is essential to introduce necessary verification system in process of military service disposal for transsexualism.
