Oil Pollution and Insurance Problems Incident

2007. 12. 7. 충남 태안에서 발생한 허베이 스피리트 유류오염사고는 유류오염손해의 전보와 관련된 전형적인 문제점을 제시하고 있다. 유조선에 의한 유류수송과 관련하여 발생하는 유류오염사고의 특징은 피해의 대형성으로 인하여 유조선주 단독으로 배상책임을 감당하기 어렵다는 점이다. 그리하여 유조선주의 배상책임을 담보하는 선주배상책임보험자가 담보하지 아니하는 손해에 관하여는 전통적으로 유류를 수입하는 화주측에서 일정기금을 갹출하여 손해보상을 분담하는 특이한 체제가 유지되어 왔으며, 이는 과거의 TOVALOP와 CRISTAL을 거쳐 지금의 국제기금체제로 안정되어 있다. 또한 국제기금만으로도 전보되지 아니한 손해가 있는 경우에는 허베이 스피리트 사고에서처럼 정부가 나서서 특별법의 형태로 보상하는 경우도 있다. 또한 화주측의 부담이 커지자 이번에는 선주측이 화주측에 맡겨졌던 보상책임을 일부를 되가져와 다시 보상하는 STOPIA, TOPIA 제도도 도입되어 있다. 이 점에서 위험분산의 기술인 보험법리가 유류오염사고에도 그대로 적용되는 것을 확인할 수 있다. 이 글은 유류오염손해전보제도의 원리와 운영법리를 설명함으로써 향후 우리나라 유류오염 손해전보제도의 운용의 합리화를 기하고, 특히 우리나라가 2003년 추가기금에 가입할지 여부를 결정함에 있어 고려할 요소들을 검토하였다.

The Hebei Spirit incident that occurred on 7 December 2007 has posed typical issues in relation to the oil pollution damages. The characteristic of the oil pollution incident is that it is so vast that a single tanker owner alone would not be able to cover all the damages. Thus, a special regime has developed in the world wherein a special fund was set up by cargo importers to make up for the shortfall of the fund that is necessary to provide proper compensation to the victims of the oil pollution incident, namely, TOVALP and CRISTAL in the past and IOPC Fund these days. As we have seen in the Hebei Spirit incident, there are occasions wherein the government may take steps by enacting special law for the full compensation to victims. Further, as the burden of the cargo importers has become severer, the tanker owner re-intervened in the compensation by establishing a special com-pensation system to the cargo importers such as STOPIA and TOPIA. This shows a typical example of risk distribution technique in insurance law. This articles was prepared to explain the basic principles and operating rules of the current oil pollution compensation system so that we may rationalize the operation of the oil pollution compensation in the future and, particularly, discussed the points that need to be checked in determining whether our country shall join in the 2003 Supplementary Fund.
