A Comparative Legal Analysis of Research Data Management

Scientific data covers the data that can be stored in digital and electronic data base, source research, testing, measurement, or investigation as survey data generated through the process of carrying out research. Scientific data has been changed to function as a major research resources under the state-of-the-art research environment, it has been considered as an important tool for scientific and technological innovation. Free access to scientific data over the past few years, the need for a legal system for the sharing and management, including the systematic utilization was raised continuously. But until now it is a small solution to this situation. Conversely discussion and legislation relating to public information or public data otherwise have been actively conducted. As a result, in July 2013 “Act on Provision and Use of Public Data” was enacted. According to Article 2 of the “public data” means the database, electronic files and public institutions are created or acquired by management for the purpose of determining laws and regulations, etc. and that light, or electronically processed data or information. In this sense, public data means academic, cultural, science and technology, can be understood as a concept that encompasses the administrative area, scientific data are also included in this concept. The focus of the Act on Provision and Use of Public Data is the provision and use of public data. But this Act has not explained where and how they are created and stored. It is impossible to provide the proper utilization of public data without proper discussion on the production and management methods and procedures of public data. This paper was developed and discussed by the relevant legislation to deal with the relevant legislation on data management science in China reusing information for the public and management of the EU and the United States. To become a scientific data management system in Korea has established various priority issues that the “public data law” must be resolved through a revision process. Next, scientific data needed with regard to the establishment of a unified enforcement rules between departments.
