커뮤니케이션학에 기초한 바람직한 법정 소통 방안에 관한 연구

Research on Effective Courtroom Communication

본 연구는 커뮤니케이션학과의 학제 간 연구를 수행하여, 커뮤니케이션학의 이론적 토대를 바탕으로 법정 커뮤니케이션에 대한 체계적인 분석을 시도하고, 이러한 분석의 실천적 활용을 위해 바람직한 법정 커뮤니케이션 모델을 정립하며, 법관의 올바른 법정 언행 확립과 법정 소통의 활성화를 위한 구체적인 정책 방안을 제시하는 것을 주된 목적으로 삼는다. 이를 위해 본 연구는 먼저 커뮤니케이션학의 주요 이론과 대표적인 커뮤니케이션 기법 및 전략을 검토하고, 이들이 구체적으로 활용된 다양한 커뮤니케이션 상황을 유형별로 비교분석하여, 법정 커뮤니케이션 모델 정립을 위한 이론적 기초를 마련하도록 한다. 또한, 법정 커뮤니케이션의 다원적 요소와 특성을 고려하여, 특히 법정의 설득 및 공감 커뮤니케이션을 활성화하기 위한, 상호주관적인 법정 커뮤니케이션 모델로의 방향성을 제시하도록 한다. 다음으로 법정 커뮤니케이션의 문제점을 검토·분석하고, 기존에 사법부에서 제시된 바 있었던 AFIR 모델을 토대로 법정 커뮤니케이션 모델의 발전적 정립을 시도하도록 한다. 나아가 법정 커뮤니케이션의 기본 모델을 바탕으로 민사재판, 민사조정, 형사재판, 국민참 여재판과 같은 구체적인 재판 유형별 쟁점 및 고려사항을 정리하도록 한다. 결론에 갈음하여, 본 연구에서 정립된 법정 커뮤니케이션 모델의 활용과 바람직한 법정 커뮤니케이션 문화의 확립을 위한 구체적인 정책 방안을 제안함으로써 논의를 마무리하고자 한다.

Based on interdisciplinary research with communication studies, this research analyses courtroom communication, establishes a desirable model of courtroom communication, and devises concrete policies to vitalize communication in the courtroom. First, as a theoretical foundation, this research examines major theories, techniques and strategies of communication, and analyses several types of the communication situation. Furthermore, this research provides plural elements and characteristics of courtroom com-munication, and suggests the intersubjective courtroom communication model, which con-siders both persuasive communication and empathic communication simultaneously. Moreover, this research grasps major problems in the existing courtroom communication, develops the goals and techniques of courtroom communication, and summarizes several is-sues and considerations in each type of trial, including a civil trial, mediation, criminal tri-al, and citizen participation in criminal trials. In conclusion, this research suggests the proper ways to utilize the established courtroom communication model.
