미국에서의 투표자신원확인법 도입을 둘러싼 논란과 우리 선거법제에 대한 시사점

Perry 사건에서 동법이 각 합헌이라고 선언한 바 있으나, 위 연방 대법원판결은 투표과정에서 이루어지는 엄격한 신원확인 절차가 헌법상 선거권을 침해하는지를 두고서 대법관 의견이 5대 4로 치열하게 나뉘었다는 점에서 위 법 시행에 따른 찬반양론은 지금도 계속되고 있는 것이다. 한편 위와 같은 미국에서의 논의는 우리나라 선거법제에도 시사하는 바가 큰데, 선거는 공정해야 한다는 측면에서 보면 투표과정에서 투표자의 정확하고도 엄격한 신원확인 절차는 공정선거의 필요 전제조건이라고 볼 수 있다. 그러나 지나치게 엄격한 신원확인제의 시행으로 인하여 헌법상 보장된 선거권이 제한받는다면 달리 생각해 볼 문제이다. 선거권은 대의제 민주주의를 지탱하며 대의제 민주주의와 함께하는 생래적, 기능적 기본권으로서 최대한 보장이 되어야 한다. 그러므로 단순히 선거의 공정성만을 내세워 어떠한 절차상의 차별을 만들고 그로 인하여 궁극적으로 국민으로 하여금 투표권 행사 자체를 금지하는 결과를 초래하여서는 안 된다. 즉 선거의 공정성을 확보하는 것은 일차적으로 국가의 과제이므로 공정선거 문제를 선거권자의 책임으로만 돌려 선거의 공정성에 대한 우려가 있다는 이유만으로 선거일에 주민등록증을 소지하지 못한 국민들에게 선거권 행사를 전면 부정함은 부당하다. 따라서 현재와 같은 엄격한 신원확인절차 이외에도 본인을 증명하는 다양한 방법으로서 대학생의 경우 학생증, 의료보험증, 공공도서관 이용증, 공공기관 사원증, 변호사신분증 등 본인을 충분히 확인할 수 있는 특정한 수단을 제시하는 경우 내지는 본인 주민번호와 주소지를 묻는 질문과 추후 본인이 아닌 것이 적발될 경우 엄격한 형사처벌을 받겠다는 서약을 하는 경우 등에는 소중한 투표권을 행사할 수 있도록 허용하는 방향으로 현행 공직선거법 제157조 규정을 개정할 필요가 있다.
