임대차분쟁조정제도 도입에 관한 법적 고찰

Legal Study on the Introduction of a Lease Dispute Settlement System - Focusing on Ensuring Enforceability -

본고의 목적은 임대차분쟁조정제도의 도입을 촉구하기 위한 것이다. 이론적 관점 외에도 특히 정책적 관점에서 집행력을 인정하는 분쟁해결방안을 찾고자 하였다. 조정결과에 대하여 집행력을 부여하는 임대차분쟁조정제도는 법적으로 신설되어야 하고, 그러한 공증에 의한 임대차분쟁의 해결은 사회적 비용을 절감할 수 있고, 헌법위반의 소지를 제거할 수 있을 것으로 기대된다.

1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this study is to urge the introduction of the tenancy dispute settlement system. (2) RESEARCH METHOD This study is theoretical, it was to find a solution to the dispute acknowledge the enforceability From a policy perspective. (3) RESEARCH FINDINGS Lease dispute resolution system that grants enforceability shall be established by law. 2. RESULTS By notarial lease dispute resolution is to reduce the social costs, and is expected to be removed in possession of a violation of the Constitution.
