An Employee Stock Ownership Plan is a system planned on the assumption that the support of company is needed to promote the cooperation of capital and labor and to improve the economic and social status of employees. It can be achieved by making employees obtain and retain the stock of the company which employs them. The Employee Stock Ownership Plan was reorganized by enacting the Framework Act on Employee's Welfare in 2001 and now is regulated by the Framework Act on Labor Welfare. The Employee Stock Ownership Plan under the Framework Act on Labor Welfare became widespread for a short period in the Republic of Korea. The Employee Stock Ownership Plan is an employee-owner scheme that provides a company's employees with an ownership interest in the company. The propose of the Employee Stock Ownership Plan is to increase the welfare of the employees. In this article, I will deal with the legal problems regarding the Employee Stock Ownership Plan, with emphasis on the employees' stock option under the Framework Act on Labor Welfare.
