법률문헌 등의 인용방법에 관한 연구

Research on Legal Citation - Appendix: a sample guide to legal citation

본 연구는 법률문헌 등을 인용함에 있어 합리적이고도 적절한 인용 표시 방법을 제안하는 것을 목적으로 하는 연구이다. 그러므로 먼저 문헌의 인용에 대한 필요성과 원칙에 대하여 간단히 살펴보았다. 한편 적절한 인용방법을 제안하기 위하여서는 먼저 국내에서의 법률문헌 등의 인용방법의 실태를 파악하는 것이 중요하다고 판단된바, 국내에서 실질적으로 사용되고 있는 법률문헌 등의 인용방법을 분석하고 정리하여 이를 전반적으로 검토하였다. 또한, 사회과학분야에서의 인용방법은 법률문헌 등의 인용방법과 어떠한 차이점이 있는지도 알아보았다. 한국의 법 연구 환경에 적합한 법률문헌 등의 인용방법을 연구하기 위한 선제적 조건으로서 외국의 인용방법과 그 현황을 조사하고 검토하여 보는 것도 필요하기에 각국의 인용 방법에 대하여도 조사하고 검토하였다. 이러한 현황의 검토 및 연구를 바탕으로 하여 본 표준안 개발의 기본 방향과 본 표준안의 특징 등을 논한 후, 다수의 전문가 감수 의견을 수렴하여 하나의 표준이 될 수 있는 시안을 완성하였다. 본 연구에 따른 법률문헌 인용방법 시안은 누구든지 곧바로 쉽게 사용할 수 있도록 하였다.

This research aims at developing a reasonable and practical legal citation typically suited for the legal research environment of Korea. Thus the first thing discussed in this writing is the basic principles of legal citation, including the necessity of such. With a view to provide an optimal legal citation model for Korea, the research then studies the current state of legal citations. Various existing citations in Korea are reviewed and summarized for this purpose. The notable difference between the legal citation and the citation in the area of social studies is quickly examined here as well. Also, legal citations of foreign countries are analysed in order to cultivate a better ground for designing legal citation for Korea. All of the above now leads this article to propose a desirable scheme under which the legal citation should be developed. Reviewed by many experts in the field, the research finally presents an exemplary legal citation package available for everyone to use with ease.
