Suggestions for Constructing a Global ODR System for Activating Cross-border E-Commerce

본고에서는 점증하는 범세계적 ODR 시스템 구축의 필요성에 관하여 검토해 보기로 한다. 범세계적 ODR 시스템 구축을 발전시켜 나가기 위해, 본고에서는 eBay, Concilianet, ICANN, BBB, OAS, ECRI 등과 같은 현존하는 ODR 시스템의 구조와 운영을 검토한다. 범세계적 ODR 시스템에서는 공공기관들(정책 수립자, 법률가 및 법률 제정자 포함), 소비자들, 온라인 사업가들, 대금지불 채널들, ODR 서비스 제공업자들을 포함한 모든 참여자들의 관심에 대한 균형적인 배려를 위해 낮은 가치/많은 수량의 분쟁에 대한 ODR 시스템의 도입을 상업계에서 요구하고 있다. 이러한 맥락에서 본고에서는 ODR 시스템 내에서 참여자들로 하여금 많은 수량의 낮은 가치상품에 대한 클레임에서는 신속하고 단순하며 비용이 적게 드는 분쟁해결절차를 이용할 수 있도록 해주고, 적은 수량의 높은 가치상품에 대한 클레임에 대해서는 정교하면서도 비용이 많이 들고 서서히 진행되지만 더욱 정교한 분쟁해결절차를 이용할 수 있도록 해줌으로써, 그 선택권을 분쟁당사자들에게 부여해주는 방식이 채택될 필요가 있다는 결론을 도출할 수 있다.

This paper examines the growing need for global Online Dispute Resolution(ODR) system construction. To facilitate the construction of a global ODR system, this paper reviews the structures and the operations of existing ODR systems such as eBay, Concilianet, ICANN, BBB, OAS, ECRI. The commercial community needs the creation of a fast track low-value/high-volume ODR system which balances the concerns of a stakeholders, including public agencies (as police makers, legislators and regulators), consumers, online business, payment channels, and ODR providers in a global ODR system. Therefore, it is concluded that there is needs to create a global ODR system which gives stakeholders the option to choose a fast track, simplified, inexpensive process for low-value/high volume claims or a slower, sophisticated, costly but more detailed process for high-value/low-volume claims.
