A Study on the ODR utilization for the effective resolution of international e-commerce dispute

국제 전자상거래 분쟁의 효과적 해결을 위한 ODR 활용방안에 관한 연구

본 논문은 국제 전자상거래 분쟁을 효과적으로 해결하기 위해 국내 ODR제도를 보다 적극적으로 활용하기 위한 방안 제시를 목적으로 한다. 이를 위해 현재 ODR과 관련된 국내 ․ 외적 환경을 분석하고 특히 ODR을 다루고 있는 국내 주요 ADR기관들에 대해 살펴보았다. 그러나 UNCITRAL에서 추진 중인 ODR모델규칙의 방향성에 비추어 볼 때 국내 분쟁해결기 관들의 국제화 수준은 낮은 편이라 이를 극복해야 할 과제를 안고 있다. 따라서 본 연구에서는 이를 극복하기 위해 분쟁당사자 측면에서 ODR 효과를 극대화시키기 위한 방안에 대 해 고찰하였다. 우선 국제 전자상거래 관련 분쟁에서 나타날 수 있는 문제점들을 B2B나 B2C시장으로 구분하여 살펴보았다. 그리고 이를 토대로 분쟁당사자 입장에서 국내 ODR이 활성화되기 위한 방안을 제안하고 있다. 이를 위해 분쟁해결기관이 가져야 할 전략과 제도 및 기술적 개선방안에 대해 구체적으로 제시하여 분쟁당사자들의 실익은 물론 국가 차원에서의 경쟁력 강화로 이어질 수 있도록 제안하고자 한다.

The purpose of this article is suggesting a plan to actively utilize the domestic ODR system to effectively resolve the international E-commerce disputes. To suggest solution, we analyze local and abroad environment related to nowadays ODR, especially research into local major ADR institutions where manage ODR. So, we consider a plan to maximize ODR-effect in disputer’s view to solve the problem. However, considering the direction for the rule of ODR model which is carried by UNCITRAL, it has some challenges to get over, because internationalization level of domestic dispute resolution organizations seems low. First, we examined the problems that may occur in the international E-commerce, by separating B2B or B2C market. And based on this analysis, we suggest plans to revitalize ODR of domestic from a party to a dispute position. We specifically suggest a strategy, system and technological improvement plan that dispute resolution in tuition should have, and we propose that this effort can be connected to actual profit of dispute resolution in tuition and strengthen competitiveness of national level.
