An ODR Platform in the EU and ODR in the UNCITRAL for Consumer Dispute Resolution : Comments on Korean ODR

소비자 분쟁해결을 위한 EU의 ODR플랫폼 및 UNCITRAL의 ODR : 우리나라 ODR에 대한 시사점

ODR에 대한 법제정, IT기술을 포함한 시스템개발 등에 관한 연구 활동은 많은 국제기구나 경제단체, ODR관련분야의 전문가들을 통하여 활발히 진행되어 오고 있으며 향후 효과적인 온라인상의 분쟁해결시스템으로서 ODR에 대한 활용도는 높을 것이라고 전망된다. 본 연구를 통하여 ODR을 법제화 및 실용화하려는 EU와 UNCITRAL ODR WG의 논의 배경, 소비자 보호 및 EU의 ODR platform 과 UNCITRAL ODR의 진행절차 등을 중심으로 살펴보고자 한다. 또한 이들 EU와 UNCITRAL의 차이점을 비교하여 우리나라 ODR에 대한 시사점 및 우리나라의 ODR의 현황과 향후 방향을 전망하고자 한다. 따라서, 본 연구를 통하여 온라인상에서 발생되는 클레임들을 신속하고 효율적으로 해결할 수 있도록 우리나라에서도 ODR의 실용성을 높이는데 기여하고자 한다.

Purpose : This paper focuses on examining on an ODR(online dispute resolution) platform in the EU and ODR in the UNCITRAL and on comparing the EU with the UNCITRAL regarding ODR and then, this paper reviews comments on Korean ODR for the development of ODR in South Korea. Research design, data, methodology : This paper examines the EU ODR platform and the UNCITRAL's ODR in terms of consumer protection and the proceedings and also explores Korean ODR through website searches, literature reviews and the results of international surveys and conferences. Results : The EU adopted a Regulation on consumer ODR and Directive on consumer ADR and ODR platform will be fully operational in the by 8 January 2016. Also, the UNCITRAL ODR WG has been in charge of the drafting of generic rules for an international ODR in low-value, high-volume, B2B and B2C cross-border online disputes. However, ODR in South Korea is at the beginning of stage at the present because there are unprepared rules, lack of technical methods, no private ODR providers and language issues of ODR as the main points. Conclusions : Scholars, professionals and the Korean government should make an effort to create ODR at a global level to resolve online disputes occurring out of cross-border e-commerce through resolving the main issues and proposing effective methods.
