A Study on the Loading and Stowage Obligation of Voyage Charterers in English Common Law

This thesis analyzed the liability of the cargo loading and stowage in voyage charter focusing on academic theory and English common law. The major contents are as follow. ① The preconditions for the transfer of the responsibility for the proper performance of the cargo loading and stowage to the charterers. ② The charterers' liability and exceptions where there are the clear words on the responsibility for loading and stowage to one of the contractual parties. Regarding the above ①, English Common Law and the academic theory take the same interpretation standards. As to the above ②, especially, the English Common Law provides standards for interpretation in detail, but, there are no such standards in the Korean Commercial Law. When I consider that the disputes connected with the cargo loading and stowage may be variously happened, I think that it is necessary to have the regulations that can minimize the disputes concerning the loading and stowage between the contractual parties in the Korean Commercial Law.
