경제성장과 다원화사회로의 변화속에서 우리사회에서의 규제입법의 개선을 위한 쟁점은 정부규제 부작용의 문제를 해소하고 행정, 경제, 생활 영역에서의 국민적 편의성과 자율성을 확보하여 국민의 질적 생활의 개선과 국가경쟁력의 향상에 초점이 맞추어져 왔다. 최근 규제의 개선을 위한 목적으로 관이 주도하던 관료주의 지배하의 복잡한 행정절차의 간소화와 경제영역의 효율성 측면에서 시장의 자율성을 강화하고 시장기능을 확대하여 사회적 유연성을 강화함과 동시에 행 정비용의 감소 및 사회경제적 경쟁력의 향상을 위한 규제입법의 개선을 위한 다양한 제도적 장치들이 도입되고 있다. 또한 정부는 지속되어온 만연한 관료주의 사회에서 민이 자율성을 가지고 끊임없이 외부사회와 경쟁하는 민간 중심사회로의 변화를 위하여 노력해 나가고 있다. 규제의 문제는 우리의 사회문화영역에서 세분화되어 다양한 영역별로 적용이 될 수 있다. 국민의 안전생활과 관련된 분야는 규제강화의 측면에 초점을 두고 제도화 되어 헌법상 보장된 행복추구권 실현의 가치 하에 국민의 안전한 생활이 질적으로 보장되어야 할 것이며, 행정절차의 측면에서는 행정절차의 간소화와 비용절감을 통하여 국민의 행정관련 경제비용을 개선하여야 할 것이다. 또한 경제적 측면에서는 개인과 기업의 자유와 창의보장 측면에서 완화된 규제 및 적정규제를 적용하여 경제성 장의 기제로 작용할 수 있도록 해야 할 것이다. 규제개혁 및 개선은 규제완화냐 규제강화냐의 이원론적 측면이 아니라 ‘합리적 규제와 규제의 적정성’이라는 문제에 핵심이 있다. 규제의 합리적 적정기준의 설정이 개별법에서의 입법정책적 규제개선의 효과를 극대화하는 것이다. 규제개혁의 최선의 목표는 합리적·적정규제가 실현된 최적의 입법목적의 실현을 통하여 국민 삶의 질적 변화와 지속적 경제성장의 환경을 조성해 나가는 것이다.

For the purpose of improvement of the regulatory, the purpose for the improvement of regulatory legislation was to introduced the institutional devices that can enhance social flexibility by simplified the complex administrative procedures in the bureaucracy and enhanced autonomy in economic terms. In addition, the society are in the midst of change of the society that citizen has led to the government out of bureaucracy. Regulatory issues can be applied in our various living areas. Public safety-related areas should rationalize the unfair life by more strengthen the safety regulation in terms of the safety in the value of the right of pursuing happiness that constitutionally guaranteed and simplified of the complex administrative procedures in terms of administrative procedures. Also in economic terms, Regulatory reform is able to achieve economic growth by applying a relaxed regulatory in terms of the freedom of individuals and garantee of creativity. The regulatory reform is in the intrinsic problem not dualism of regulatory or regulatory relief but reasonable or appropriate regulation. The setting of appropriate standards of regulation can be maximized the effect of regulatory reform in the legislation. The best purpose of regulatory reform is to relieve the discomfort of the people and enhance national competitiveness by reasonable or appropriate regulation.
