The present and future of death with dignity

존엄사는 인간이 품위 있게 죽을 수 있는 권리에 대한 논쟁이다. 연명치료를 중단하는 이른바 존엄사(death with dignity; passive Sterbehife) 는 지금도 논란의 중심에 서 있다. 우리나라를 비롯하여 외국의 경우 존엄사를 인정하고 있다. 하지만 존엄사에 대한 논의는 여러 가지 형법적 의문점을 가지고 있다. 법학적으로는 생명에 대한 개인적 처분 가느엉의 여부와 그 한계 및 의학적 살인행위와 자살관여에 이르기까지 많은 부분에서 논의의 여지가 있다. 존엄사는 인간의 연명치료를 중지하는 것을 의미하므로 치료를 포기하는 것은 생명권을 침해한다고도 볼 수 있는 여지가 있어 신중한 법적 해석을 요한다. 이렇듯 존엄사는 환자개인의 자기결정권과 최대한의 의료적 조치를 취해야 하는 의료윤리와의 충돌되는 부분이라 할 수 있다. 최근 우리 대법원의 판결은 법률의 규정이 없더라고 연명치료의 중단은 엄격한 요건하에서 가능한 것으로 판시하였다. 이는 기존에 있었던 안락사 및 존엄사에 대한 단순 인정여부를 떠나 객관적 판단기준 및 절차에 관한 논의로 일보 전진한 논의가 필요함을 요구한다 볼 수 있다. 이에 본 논문에서는 현재 외국의 논의상황과 판례 등의 검토를 통하여 우리 논의의 방향성을 제시하여 보았다.
