레옹 뒤기의 생애와 그의 시대

Léon Duguit and his Age

레옹 뒤기는 근대 프랑스 헌법학의 기초를 확립한 학자로서 A. 에스맹, 모리스 오류, 카레 드 말베르그 등과 함께 프랑스 제3공화국 시기의 중요한 인물의 한 사람이다. 그러나 한국의 공법 학계에서는 여전히 그에 대한 관심이 부족한 실정이므로 여기서는 그의 생애와 저작 일반을 소개하여 뒤기는 물론 프랑스 헌법학과 근대 헌법의 기원에 관하여 체계적으로 연구하는 계기를 마련하고자 한다. 특히 뒤기는 19세기 말과 20세기 초라는 세기의 전환기에 헌법학자로서 활약한 사람이며, 프랑스 제3공화국 시기의 프랑스는 경제적·사회적 조건과 국가기능 그리고 법사상 내지 사회과학 방법론 모두에 있어 근본적인 변천의 시대였다. 자본주의의 고도화와 노동운동으로 인하여 사회문제가 심각해지고, 계급대립과 투쟁이 격화되는가 하면 행정기능의 확대와 강화로 야경국가에서 복지국가로, 개인주의에서 사회연대주의로의 진전이 시작되었다. 이러한 세기의 전환기에 헌법학자로서 뒤기는 실증주의, 사회적 연대주의, 객관주의 법이론, 객관법 또는 법의 준칙에 의한 국가권력의 제한 그리고 공공 서비스 이론 등을 전개하였다. 본 연구에서는 뒤기가 생존했던 프랑스 제3공화국 시대의 정치적·사회적·경제적 배경을 묘사하여 그의 헌법이론의 배경을 이해하는데 기여하고자 한다.

Léon Duguit is a leading French scholar of constitutional law with A. Esmein, Maurice Hauriou and R. Carré de Malberg during the period of the French third Republic. However, he is still not widely known in the academic world of Korean public law. That's why here, I introduce Léon Duguit and his age. I want to study the french constitutional law and the origin of modern constitutional law systematically as well as Léon Duguit's life and his work. Especially, he was at a turning point in french history, that is, from the late 19th century to the early 20th century. The period of French third Republic was a time of transition. At that time, in France there was a rapid change of economic and social situation, therefore, fundamental change of the function of State and the social science search methodology was required. The sophistication of capitalism and the labor movement has caused serious social problems such as class conflict. Moreover, in conformity with the consolidation of the administrative powers, there was a change from Nachtwachterstaat to a welfare state, from individualism to solidarism. In this time of change Léon Duguit has developed positivism, solidarism, theory of objective law, limitation of state power by rule of law and public service theory. In this study, I would like to describe political, social and economic background of his age, then contribute to our understanding of his constitutional theory.
