Study on The Possibility of Successive Adoption

The paper reviews the possibility of successive adoption in South Korea when the previous adoption has not been yet settled. That is the possibility of successive adoption without the settlement of adoption, in other words the annulment and cancellation of adoption and breakdown of adoption. South Korea, unlike Germany and France, has no law stipulating that such cases are prohibited, and therefore in this thesis the possibility of successive adoption based on the court decisions is discussed. Also, as the successive adoption relates to the adoption by adoptive parents who are same-sex couples and as increasing number of states recognize either the legal rights of same-sex couples or same-sex marriage, the possibility of adoption by adoptive parents who are same-sex couples and their habitual residence is located overseas is discussed.
