도선제도 및 도선법에 관한 연혁적 고찰

오늘날 파일럿(Pilot)이라고 하면 대부분의 사람들은 항공기 조종사를 떠올린다. 그러나 이 용어는 해상에서 먼저 사용된 용어다. 연혁적으로 살펴보면 항공기가 탄생하기 전에도 해상분야에서는 ‘pilot’라는 용어를 사용하고 있었다. 그럼으로 그 기원이 바다에 있다는 것을 알 수 있다. 약 2,500년 전 고대시대의 로오드해법은 일부분이 소실되었지만 단편적인 부분에서 도선사의 존재와 도선제도가 있었다는 것을 알 수 있고, 이후 생성된 고대 로마법과 초기 중세 해법에서 도선제도의 구체적인 내용을 알 수 있다. 당시에는 도선의 실수로 인하여 선박이나 화물에 손해를 입히거나 멸실되면, 도선을 실시한 도선사는 지금은 상상할 수 없는 참수형에 처해졌다. 이는 당시 시대 상황을 반영한다. 고대 및 중세시대가 전제군주 시대였고, 마음대로 그 권력을 남용하였음을 알 수 있다. 그리고 도선사에게는 목숨을 걸고 도선에 임하여야 하는 막대한 책임감을 부여하였다. 이러한 도선사의 책임에 대해서는 16세기에 들어서야 비로소 항변권과 손해에 대한 보상으로 그 책임을 면할 수 있었다. 현대에 존재하는 공적규제로써의 강제도선제도는 과거 중세 해법에서부터 그 연혁을 찾아볼 수 있다.

Nowadays, The most people imagines airplane operator who called the pilot. however, definitely this terms is at first used as maritime terms. Finding historically, this terms of pilot used at marine sector before invented airplane. About 2,500 years ago, We could know the fact that pilot and pilotage system exists in the ancient era from the fragmentary portions of The Rodians Law which is remained partly by burnt. We also could know that the more detailed pilotage system in after years was created in the ancient Roman Law and the Maritime Law on the early of medieval era. At the time, If damage or loss to vessel and cargo be caused by mistake of pilot, he was sentenced beheaded big surprisedly. this is reflection of social mood of that period. The ancient era and medieval era was the age of empire in despot, we could find that a power of the monarch was abuse. and requires pilot enormous responsibility at the risk of his life during guide vessel. Entering 16th century, The Pilot’s responsibility in law was started to change for the first time to be free from abused laden by taking his right of defense and monetary compensation to the owner for the loss or damage. The history of compulsory pilotage as public regulation could be found in maritime law which is developing from medieval era.
