증오범죄의 형사정책적 대응방안에 관한 연구

최근 TV, 뉴스, 인터넷을 통하여 불특정 다수를 향한 살인․방화․강간 등이 일어났다는 ‘묻지마 범죄’ 혹은 ‘증오범죄’에 관한 소식들을 접하고 있다. 또한 최근 에는 정보를 널리, 그리고 빠르게 보급할 수 있는 인터넷상에서의 증오범죄가 증가하고 있다는 점에 특색이 있다. 이러한 증오범죄는 피해자의 충격이 일반범죄 보다 훨씬 크며, 범죄자와 관계없는 불특정 다수에게 발생한다는 점에서 어느 누구도 피해자가 될 수 있다는 사실이 사회적으로 큰 파장을 불러일으킨다. 일반적으로 증오범죄의 발생률이 가장 높은 미국에서 다루어지는 증오범죄는 편견이 동기가 되어 범죄로 이어지는 것이 많으며, 우리나라에서 증오범죄라는 개념으로 이해하고 있는 것과는 다소 차이가 있다. 따라서 본 연구에서는 증오범죄의 올바른 개념의 정립을 통하여 특징을 파악하여 국내․외 증오범죄의 실태와 대응방안을 검토한 후, 우리나라 실정에 맞는 형사정책적 대응방안을 제시하였다.
