형사사법절차에서의 피해자 보호의 필요성이라는 세계적 조류와 국내의 상황적 필요에 의해 공판단계에서의 피해자의 참가와 권리에 대한 논의는 더욱 활발히 이루어졌고 피해자보호 관련 입법이 진행되는 계기가 되었다. 또한 최근 성폭력 범죄와 아동․청소년 대상 범죄의 급증으로 인한 피해자에 대해 관심이 증가하는 사회분위기 속에서 피해자에 대한 입법적 대처와 보호가 두텁게 이루어지고 있는 가운데 피해자참가제도의 도입 논의 중에 있다. 우리의 경우 피해자의 형사절차 참여 제도 도입을 검토함에 있어 2008년부터 이미 시행 중인 일본의 피해자 참가제도를 모델로 참고하였다. 양국에 있어 범죄 피해자 보호에 대한 인식과 대처가 각국의 상황과 필요에 의해 진행되고 있는 바 각 제도와 법률의 내용과 운영현황의 비교는 의의를 가진다. 이에 우리 법문화에 맞는 제도 도입과 성공적 정착을 위해 선행경험국인 일본의 피해자참가제도의 도입과정에서부터 운영현황과 그 경과분석, 학계와 실무계의 평가와 시행착오, 문제점 등을 다각적으로 검토 한다.
