독일 지방정부의 부단체장제도 비교연구

A Comparative Study on the Deputy Mayor System in German Municipalities

본 연구에서는 독일 지방자치법에 기초한 4개 지방자치 모델이 지니고 있는 특성 및 이러한 유형이 변화한 경향을 살펴보았으며, 그리고 지방자치단체의 기관구성, 부단체장과 관련된 선행연구들을 분석하였다. 이러한 분류에 기초하여 슈트트가르트(Stuttgart)시, 마인즈(Mainz)시, 드레스덴(Dresden)시와 에어푸르트(Erfurt)시의 부단체장제도(Deputy Mayor System)를 비교ㆍ분석하였다. 비교의 기준은 기관구성 형태 및 부단체장 정수, 명칭, 역할(기능과 권한), 임명방법, 신분(선출직/임명직), 임기, 권한대행 여부 등이다. 독일 부단체장제도의 특징을 살펴보면, 우선적으로 도시별로 기관구성의 형태는 상당히 유사하며, 부단체장의 선출은 주로 지방의회에 의해서 이루어지고 있다. 도시별로 기본조례에 기초하여 여러 명의 부단체장을 두고 있으며, 부단체장의 명칭은 일반적으로 부시장이라고 칭하도록 하고 있으며, 경우에 따라서는 시장 등으로 칭하기도 한다. 부단체장의 전문성 확보 차원에서 임기를 보장하여 정치적 여건 변화와는 상관없이 업무를 수행할 수 있도록 하고 있다.

In this study, the four deputy mayoral models derived from the old and new municipal charters in Germany are introduced. This paper contains the analytical results regarding the different features of the four types of deputy-mayor in the German municipalities such as Stuttgart, Mainz, Dresden, and Erfurt, by digging into the common, but comparative factors, in terms of the background of local administration institutional forms and the election or appointment system, total number and term of office of deputy-mayors, together with taking into account of the roles and functions in their own or delegated powers. From the study, it can be revealed that one of the distinct features of deputy mayor system in Germany showed the similarity of the local administrative forms in the four German local governments and the election system of deputy-mayor by the local councils. The limitation of the total number of deputy mayor is basically written in the provision of the four municipal charters where it`s position is, in general, called as `deputy mayor` and `mayor` in special case. In order to maintain the professionalism of deputy mayor`s role, his or her term of office is secured regardless of political change.
