Research on the Use of Videoconferencing in Judicial Proceedings

원격영상재판이란, 음성과 영상의 실시간 쌍방향 전송기술인 영상회의기술을 이용하여 원격상태에 있는 소송관계인들이 법정에 물리적으로 출석함 없이 진행하는 재판절차를 말한다. 원격영상재판은 정보통신기술을 이용하여 사법제도를 전자화, 정보화하는 전자사법제도의 발전 단계 중 하나이며 그 정점에 놓여있는 제도이기도 하다. 본 연구는 원격영상 재판을 개관하고 외국의 이용현황을 분석하여 우리나라에서의 원격영상재판 실시를 위한 시사점을 도출하는 데에 목적이 있다. 먼저, 원격영상회의기술이 재판절차에서 이용될 수 있는지 검토하기 위하여 원격영상회의기술의 구현방식 등을 간단히 소개하고 원격영상회의기술의 이용현황을 살펴보았다. 기술적 측면의 분석이 제공해주는 시사점은 무엇보다도 원격영상재판을 실시하기 위한 영상회의기술 수준이 항상 기술적으로 완전무결할 것을 요구하지는 않으며 오히려 현재 이용 가능한 기술을 토대로 하여 최적의 제도를 설계하고 지속적으로 보완함이 중요하다는 것이다. 다음으로는 외국의 원격영상재판 이용현황을 조사하였다. 원격영상재판을 활발히 이용하고 있는 국가는 물론, 최근 도입이 시작된 예를 함께 조사하여 국가별로 나타나는 특징과 공통점을 추출하는 데에 주력하였다. 원격영상재판의 제도 설계를 위하여 주목할 부분은 원격영상재판의 가장 주된 목적이 효율성의 증진과 증인보호에 있다는 점, 그리고 외국의 원격영상재판은 각 소송법에 근거규정을 두고 있다는 점이다. 끝으로 우리나라에서 시행되었던 원격영상재판을 반성적으로 검토한다. 원격영상재판의 기술적 측면과 외국의 원격영상재판 이용현황에서 발견된 시사점을 토대로 하여 원격영상재판의 활성화를 위한 방안을 제시한다.

Videoconferencing in judicial proceedings refers to the use of virtual communication techniques in judicial hearings to facilitate the right of remote litigants or witnesses to be present at the hearings. The use of videoconferencing is part of a critical stage of development of E-justice, which aims to digitalize and informationize the judicial system. The purpose of this study is to find implications for videoconferencing in judicial proceedings in South Korea by identifying videoconferencing techniques and analyzing the current status of use of videoconferencing in other countries. At first this study outlines the ways in which videoconferencing techniques are implemented and examines the current status of use of videoconferencing. The examination of the technological issues reveals that absolute perfection in technology is not required for the implementation of videoconferencing in judicial proceedings. It is more important to design an optimal system with a practical technique that is currently available and to supplement it continuously. Next, this research explores the current status of use of videoconferencing in judicial proceedings in other countries. This chapter emphasizes the similarities and differences between countries, some of which vigorously use videoconferencing in judicial proceedings and others of which have just adopted it. It is important that the primary purposes of the use of videoconferencing in judicial proceedings are to increase efficiency and protect witnesses. Finally, this research examines videoconferencing that has been implemented for judicial proceedings in South Korea. Based on the examinations on videoconferencing technology and the use of videoconferencing in other countries, it then provides recommendations for promoting videoconferencing in judicial proceedings.
