「부정청탁 및 금품 등 수수의 금지에 관한 법률」의 법적 문제점과 개선방향

A Constitutional Study on the Problems of the Anti-Solicitation Act, So-called 'Kim Young-ran Act'

공직의 청렴성은 이를 아무리 강조해도 결코 지나침이 없다. 공직은 그 권력적ㆍ독점적 성격과 지위로 인하여 공직자의 이익 추구를 위한 수단으로 전락하거나 특정한 이해에 봉사할 때 국민의 인권보장이라는 목적을 달성할 수 없을 뿐 아니라 '국민 전체에 대한 봉사자'로서의 역할을 수행할 수 없게 된다. 공직의 부패방지 또는 청렴성 확보를 위하여 종래 뇌물죄(형법 제129조 등) 등 범죄에 대해 처벌이 이뤄졌으며, 경찰이나 검찰과 함께 부패방지위원회 또는 국가청렴위원회 등이 구성되어 활동해 왔다. 그러나 공직의 청렴성이 혁신적으로 바뀌지는 않았다. 이런 점에서 부정청탁 및 금품 등 수수의 금지에 관한 법률 은 시의성을 가진 법률이며 공직사회에 중요한 전기를 제공할 것으로 기대한다. 그러나 이 법률은 그 취지나 필요성에도 불구하고 지나치게 성급하게 법률이 제정되었다는 평가를 할 수 있다. 당초 정부안에서 비중을 두었던 공직자의 이해충돌에 관한 부분이 분리되어 부정청탁 및 금품수수의 금지에 한정된 것도 아쉬움이 많다. 오랜 시간의 연구를 통하여 만들어진 정부안을 국회에서 면밀하게 검토하지 않은 채 폐기하고 정무위원회안을 바탕으로 의결한 것도 논란이 일게 된 원인이 된다. 특히, 언론기관을 법률의 적용범위에 포함시킨 것은 법률체계에서도 문제이다. 선출직 공직자에 대해서는 그 이외의 사람들에 대해 금지되는 행위의 예외로 한 것도 문제이다. 이 법률이 명확성의 원칙이나 연좌제 금지 원칙에 위반된다고 할 수는 없겠지만, 이러한 문제는 결코 가볍지 않다.

Despite the rapid economic growth, the corruption perception index of Korea is comparatively low. It becomes one reason to make the law regarding the anti-corruption act. In 2015, an act on the Prohibition of Illegal Solicitation and Reception of Bribes was enacted. The Act aims to ensure the citizen's confidence on the public office by guaranteeing the clean and fair performance of office. But the Act has legal problems in some respects, even though it has good reason and purpose. The act has the some problems from the constitutional perspective. 1)It has not enough reason that the act is applied to all the employees of the press including the reporters. 2)The giving and receiving money between the family is exempted from the application of the act, even though the money is related with illegal solicitation. 3)The act has some unconstitutional problems from the principle of equality and proportionality. It contains some legal problems because it was legislated in haste. The National Assembly has the responsibility to guarantee the fundamental human rights by legislation, and it should revise the provisions which have legal problems. But regardless of the problems, the act should be enforced to ensure the fair performance of the public office after the revision of the act.
