동산공시제도 및 동산담보제도의 개선 방안에 관한 연구

Research on the Improvement of Reporting Related to Personal Property Public Notice System and Personal Property Security System

기업의 자금조달 수단을 다양화하고 특히 중소기업 및 영세 자영업자의 자금조달 편의를 제고하기 위해 2010. 6. 10.에 동산·채권 등의 담보에 관한 법률이 제정되어 2012. 6. 11.부터 시행되고 있다. 그러나 동산담보대출은 처음의 기대와는 달리 높은 이용률을 보여주지 못하고 있는 실정이며, 그 원인으로 다양한 문제점들이 지적되고 있다. 본 연구는 현재 동산담보제도가 가지고 있는 여러 문제점 및 그 원인을 분석하고 동산담보제도 활선화를 위한 대안을 제시함으로써 동산담보제도가 원래의 목적을 달성할 수 있도록 하는데 도움이 되고자 한다. 우선 비교법적 고찰로서, 미국과 일본, UNCITRAL과 EBRD의 담보제도에 대해 살펴보고, 다음으로는 우리나라의 동산담보제도에 대해 법률의 내용과 동산담보제도가 이용되는 현황, 동산담보제도가 잘 활용되지 않는 원인에 대해 분석하고 제도의 문제점을 파악하고자 한다. 세 전째로는 앞의 문제점 분석에 근거하여 동산담보제도의 개선방안에 대해 다루며, 마지막으로는 동산담보목적물의 관리나 동산담보권의 공시, 동산담보목적물 DB구축 등에 활용도가 매우 높을 것으로 기대되는 디지털 기술을 활용한 동산담보목적물 관리 방안에 대해 살펴보고자 한다.

With the purpose of diversifying financing means for enterprises and improving financing convenience for medium or small-scaled businesses or individual proprietor, the Act on Security over Moveable Property, Claims, Etc. was passed on 2010. 6. 10. and has been in effect since 2012. 6. 11. Nevertheless, Asset Based Lending(ABL) has shown low utilization rate contrary to the initial expectation, and various issues have been pointed out as the underlying causes. This study aims to investigate several issues and their causes within the current ABL and to suggest an alternative in an attempt to galvanize the impact of ABL so that it would serve its original purpose. First, this study examines security systems in USA, Japan, UNCITRAL, and EBRD via comparative study methods. Second, this study investigates legalities and the status quo of ABL in South Korea, analyzes causative factors underneath the low utilitzation rate of ABL, and identifies issues within ABL. Third, based on this analysis, this study will discuss measures to improve ABL, and the last section explores information technology based collateral monitoring methods, which shows promising applicability to collateral monitoring, notice of security over movable property, and database construction.
