The Feature of environmental litigation in Japan and Social Function

이 글은 越智敏裕, “環境訴訟의 系譜-環境訴訟의 特徵과 社會的 機能-”, 「法學セミナ」(2009, 10), no.658. pp.26-30을 번역정리하였다. 이글은 환경소송을 공해구제소송과 환경보호소송으로 나누어 간략하게 정의하고, 환경행정소송은 사업자, 피해자, 행정의 3면관계쟁송구조를 취하고 있다. 환경소송의 형태는 환경민사소송과 환경행정소송으로 나누고, 환경민사소송은 가해자의 불법행위에 대한 손해배상청구소송과 피해금지소송 및 예방소송으로 나눈다. 환경행정소송은 민간에 의한 사업개발과 공공사업에 의한 환경부하의 예방을 목적으로 하는 소송을 말한다. 최근 환경법이 탄생발전됨에 따라 환경행정소송의 역할이 확대되고 있으나 환경행정소송의 결함은 환경민사소송으로 보완할 수 있다고 본다. 그리고 환경보호소송의 특징으로 환경이익에 따라 시공적 확산성, 불가역성, 불확실성을 들고 있고, 환경분야를 대기오염, 수질오염, 소음진동, 공항기지소음, 폐기물, 일조경관시가지조성, 자연보호, 화학물질, 원자력발전소의 설치조업 분야로 나누어 관련 환경소송을 검토하고 있다. 또한 환경소송의 과제로 환경민사소송에서는 소액다수피해자에 대한 집단소송, 환경행정소송에서는 조기단계의 구제소송이나 집행정지요건을 완화검토하고 있다. 마지막으로 환경분쟁의 해결방안으로 개별사안에 대한 구체적인 환경보호뿐만 아니라 환경법정책의 형성의 단계로 행정형ADR과 환경입법에 의한 해결이 요구된다고 하였다.
