경찰의 효율적 테이저 운용을 위한 제도적 개선방안

Institutional Improvement for the Efficient Taser Operation of Police

테이저가 경찰에 보급된 지 10년이 경과했다. 국내외적으로 안전성논란이 지속되고 있지만 경찰관서에 1만정 이상이 지급되어 있다. 테이저는 경찰과 피의자 양측에 긍정적 효과가 있지만 사용방법과 주의사항 미준수 등으로 인한 치명적 결과가 발생할 우려가 상존한다.본 연구는 이러한 딜레마적 속성이 있는 테이저의 안전한 운용을 위한 발전방안을 국내외 선행연구와 외국 경찰의 운용현황을 검토하여네 가지 측면에서 제언하였다. 첫째, 일선 경찰관의 테이저 교육에 혁신이 필요하다. 이론과 실습으로 분야를 구분하여 최소 8시간의 프로그램으로 구성해야 한다. 이론교육에는 테이저의 기술적•전기적•의료적 정보가 포함되어야하고 실습교육은 시나리오에 기반한 현장훈련이 실시되어야 한다. 교육훈련을이수한 경우만 테이저를 운용할 수 있도록 하는 자격인증제의 시행도필요하다. 둘째, 테이저 사용에 관한 현장대응 중심의 단계를 규정화하여 규범의 한계를 보완해야 한다. 미국 경찰의 무기사용등급과 같이 테이저의사용단계를 제정하여 적정한 테이저링의 가이드 라인을 제시하는 것이요청된다. 셋째, 사용보고의 구체화를 통한 관리방안을 보완하고 과학적 장비관리를 위해 운영상의 통계자료를 분석해야 한다.끝으로 테이저에 대한 지급제한과 장비명칭의 개선이 요구된다. 무기지급을 금지하는 대상을 지정하는 방식이 바람직할 것이다. 작동원리를 반영하여 전기충격을 부각시키는 명칭개선으로 장비에 대한 경각심을 증대시키는 방안도 검토되어야 한다.

The taser devices was introduced to the South Korea police 10 yearsago. There is controversy around tasering at domestic and abroad, but more than ten thousand tasers are placed in a police agencies. Taser has positive effects for both the police and the suspect but It canbe lethality depending on how to use. This study suggested four ways the development plan for the safe operation of the conducted energy devices. The research was conducted by reviewing preceding research and operational status of foreign police.First, Taser education of the field officer should be strengthened. Education should be a minimum of 8 hours of theory and practice programs. Theoretical training should include technical, electrical and medical information. Second, use of force continum should define on tasers and establish guidelines for tasering. Third, it should be strictly managed by a specific taser use reports. Reporting data can indicates that taser use actually decreases of police and suspect injury. Finally, improvement of supply restrictions and device name is required. It would be desirable to specify the ineligibility of taser supply. Renaming toemphasize the electrical shock can increase the user s awareness.
