고령화 사회와 간병범죄

Population Aging and Caregiving Crime

프란츠 카프카(Franz Kafka)의 단편소설《변신》은 가족 이야기라 할 수 있다.《변신》이라는 작품을 통해 카프카가 보여주는 무서운 진실은 세상에서 가장 순수하고 아름다운 사랑, 곧 가족간의 사랑조차경제적인 관계에 토대를 두고 있다는 통찰이다. 우리 사회의 가정에서는 일어나서는 안되는 사건들이 발생하고 있다. 가족 구성원을 대상으로 한 살인 등의 범죄가 일어나고 있다. 또한 생활수준의 향상과 의료기술의 진전은 대한민국이 전세계적으로 가장 빠르게 고령화가 진행되고 있다. 우리나라의 경우 2011년 65세 이상 인구의 비율이 11.4%이며,향후 고령화 속도가 더욱 빨라져 2026년에는 ‘초고령 사회’에 진입할 것으로 보인다. 고령화사회는 기대수명의 연장이라는 긍정적인 면도 있지만 치매환자의 증가로 치매환자 등의 간병으로 인한 ‘간병 살인’, ‘간병 자살’ 등의 가족간 범죄가 발생하는 부정적인 부분이 있다. 간병살인이나 간병자살 등 간병범죄는 심각한 사회문제로 등장하고 있다. 식물인간 아들을 25년 돌본 아버지, 아내 병 수발 26년 들던 노인이 극단적 선택을 했다는 소식이 잇따랐다. 얼마 전엔 아이돌 스타 아버지가 치매 앓던 부모와 함께 세상을 등졌다. 간병 살인 이라는 말이 낯설지 않다. 본고에서는 사회문제화 되고 있는 간병범죄에 대한 시론적(試論的) 연구로서 법사회학적 방법으로 고찰한다.간병범죄에 대한 사회적 대응방안으로 첫째, 간병가족의 자살 및 살인사건 현황에 대한 정확한 파악이 필요하다. 둘째, 간병 문제를 개인의 문제, 한 가족의 문제로 접근해서는 해결할 수 없고, 사회복지의 관점에서 접근해야 한다는 점이다. 셋째, 시범 실시되고 있는 포괄간호서비스제도에 대한 확대가 필요하다. 아울러 ‘생명보험전매제도(lifesettlement)’의 도입을 제시하였다.

The Metamorphosis (Die Verwandlung), a short novel written by FranzKafka is a story about a family. The scary truth that Kafka revealed through The Metamorphosis is an insight that even the purest and beautiful form of love, that is, love of family members is based on economic relations. Some awful cases that should not happen have occurred in a home of our society. Crimes including homicide have occurred targeting family members. We can read news articles ‘very frequently’ about children abusing their parents, and in worst cases, killing them, or vice versa. Owing to the improvement in quality of life and advanced medical technology, Korea is one of the countries with the rapidest population aging. According to the classification of UN, when population aged 65 and over take more than 7% of the gross population, the society is defined to have population aging. Due to rapid decrease in birth rate and improvement in medical technology and quality of life, average life expectancy is extended and as a result, population aging emerged. As for Korea, population aged 65 and over take 11.4%. It is anticipated that population aging speeds up further, which leads to‘ultra-aging society’ in 2026.Population aging has negative aspects including family crime such as‘caregiving homicide’, care giving suicide’ due to caregiving for patients with dementia or in vegetative state who are unable to move, while it has a positive aspect of extension of life expectancy. Care giving crimes such ascaregiving homicide or caregiving suicide emerge as a serious social problem. We have heard news about a father who had taken care of his son for 25 years or an elderly man who had cared for his ill wife for 26 years did executed the drastic option one after another. A few months ago, the father of an idol star committed suicide with his grandparents suffering from dementia. The term of caregiving homicide is no longer strange to us. This study is an introductory study of caregiving crime which has been a social problem, from the perspective of sociology of law.
