자치경찰제 도입과 수사권조정의 상관관계에 대한 연구:연혁적 고찰을 중심으로

A Study on Correlation between the Readjusting Investigation Right and the Introduction of the Municipal Police System

경찰개혁과 관련하여 자치경찰제와 검•경간 수사권 문제는 최근 10 여 년간 가장 활발하게 논의되었던 문제이다. 자치경찰제와 수사권 문 제는 전혀 다른 성질과 내용을 갖는 듯하면서도 권력분산을 통한 견제 와 균형이라는 측면에서 상호 밀접한 영향을 주고받는 관련성 있는 제 도이기도 하다. 이러한 점을 감안하여 이 연구는 자치경찰제와 수사권 논의를 연혁 적으로 살펴봄으로써 어떠한 관련성을 갖고 있는지, 만약 있다면 각 논의가 하나로 수렴되는 귀결점이 있는지를 찾아보고자 하였다. 구체 적으로, 첫째 경찰의 효율성이 우선시되던 시기, 둘째 경찰의 정치적 중립성이 강조되던 시기, 셋째 국가권력의 분권이 강조되는 시기로 구 분하여 자치경찰제와 수사권 논의의 상관관계를 살펴보고, 이를 기초 로 향후 양 제도의 정책적 추진에 던져주는 시사점은 무엇인지 고민해 보았다. 이러한 연구는 자치경찰제 및 수사권 문제에 관한 지금까지의 연구 가 주로 평면적•단편적 분석에 그친 것에 비해 이 연구는 역사적•체계 적 분석을 통해 정책적 함의를 찾는다는 점에서 그 의의를 찾을 수 있다.

In the field of police administration, the readjustment of investigation right between police and prosecutors and the introduction of the municipal police systems has been over last 10 years discussed and disputed. The municipal police system and the readjustment of investigation right between police and prosecutors have an entirely different nature and content, however in terms of checks and balances through distributed power, both systems are also closely related institutions. In view of the above points, this study first of all looks at the history about discussions over the municipal police system and the readjustment of investigation right. And on this basis, it is shown what there is any relevance in this discussions that is converged in one point. In other words, this study examined, whether any relevance in historical perspective, specifically in period first when efficency was emphasized, second when political neutrality of police was prevailed, third when decentralization of national power was emphasized. This study makes sense in that the research has shown significant policy implications through a historical and systematic analysis, rather than only in the piecemeal analysis in the past.
