A study on the proper methods to guarantee a democratic process of political party's candidate nomination

According to the article 8, clause 2 in Korean Constitution, Political Party Act article 29 and Public Office Election Act article 47, Korean political party's candidate nomination should be performed democratically. Despite the existence of Korean Constitution, Political Party Act and Public Office Election Act, the reality of the nomination procedures in Korea is far away from these laws, and the political party representatives has forced the nomination of candidates. As a result of undemocratic process of political party's candidate nomination, corruption in election is prevalent, including a large donation to political funds. This paper has focused on the candidate nomination system of political parties including the new system of citizens' participation in election process (to nominate candidates) and to conclude, the proper methods to guarantee a democratic process of political party's candidate nomination are suggested here, (ⅰ) a direct election by party members, (ⅱ) citizenry's opposing to nomination, (ⅲ) the exclusion of candidate nomination by political parties in a local election.
