과정추적법에 의한 정당경쟁과 국회의원 이익상충 관계의 분석

An Analysis of the Relation of Party Competition to the Conflict of Interest in the Members of the National Assembly by the Process Tracing Method

정치체제의 민주화가 공고화된 이후 국내 정당경쟁은 다당적 경쟁구조에서 양당적 경쟁구조로 점차 변화되어 왔다. 특히 제16대 국회가 출범한 2000년 이후 원내 의석점유비율 변화 등을 보면 양당적 경쟁구조의 심화현상을 확인할 수 있다. 양당적 경쟁구조의 확대와 함께 제16대 국회 이후 국회의원들의 이익상충 문제도 심화되어 왔다. 이익상충 문제는 경제적 이익상충에 국한되지 않고 직무전념의무 등 직업윤리 미준수, 국회의원 권익남용 등의 차원에서 넓게 규정될 수 있는데, 제16대 국회 이후 이익상충 문 제가 확대된 것으로 나타났다. 이러한 배경 하에서 본 연구는 질적연구방법 중 하나인 ‘과정추적법’을 통해 정당경쟁과 국회의원 이익상충에 대한 가설적인 관계를 설정하고, 이를 분석하고자 한다. 핵심 개념들에 대한 이론적 논의에 이어 원내 의석점유비율과 의원입법안 발의현황을 중심으로 국회별 정당경쟁실태를 기술하였고, 이익상충 문제는 직업윤리 미준수, 경제적 이익상충, 권익 남용의 세 가지를 중심으로 기술하였다. 본 연 구의 기본적 목적은 정당경쟁과 국회의원 이익상충의 관계에 대한 1차 이론, 즉 가설적 관계에 대한 체계적인 기술적 이론을 제시하는데 있으며, 이에 대한 보다 정교한 2차 이론, 즉 설명적 이론으로의 발전은 제한적으로 시도되었다. 분석결과 양당적 경쟁구조 의 확대는 국회의원 이익상충 문제와 밀접한 관련성이 있고, 이는 기존의 이론적 논의 들에 대한 대안적 설명이 될 수 있음을 확인하였다.

As political democratization in Korea has been consolidated since 2000, multi-party competition has gradually disappeared and two party competition emerged. In the meantime, conflict of interest problems in the members of the National Assembly has worsened since the 16th National Assembly was inaugurated in 2000. In this context, this article aims to deeply describe both party competition and the conflict of interest in National Assembly members from the 16th to the incumbent 19th Assembly, and to systematically analyze a hypothetical relation between the two phenomena by the process tracing method. Dual-party competition is described with the proportion of seats occupied by the two major parties and the number of bills initiated by the members, and conflict of interest described in the three dimensions: the misconducts of occupational ethics, conflicts of economic interest, and over-uses of prerogatives. With intensive descriptions, this articles attempts to make a descriptive theory (called Theory Ⅰ) between party competition and the conflict of interest in the members of the National Assembly and finally to build an explanatory theory (called Theory Ⅱ).
