우리나라는 2008년부터 권익위원회 소속 경찰소위원회에서 경찰관련 고충민원을 담당함으로써 경찰 전문옴부즈만으로서의 기능을 수행하고 있다. 그러나 현행 권익위원회 경찰전문옴부즈만은 조직 구성에 있어 전문성이 결여되어 있어 실효성있는 전문옴부즈만으로서의 역할을 기대하기 어렵고, 수사관련 고충민원 처리에 있어 수사구조 현실을 제대로 반영하지 못함으로써 수사관련 민원처리의 적시성과 실효성을 확보하기 어려운 문제점이 있다. 본 연구에서는 현행 경찰 전문옴부즈만의 운영실태를 법적•제도적 관점 에서 분석하고, 선진 외국의 경찰전문옴부즈만 운영사례가 주는 시사점을 검토함으로써 개선방안을 제시하고자 한다. 우선, 경찰전문옴부즈만의 전문성제고와 업무의 능률성을 위해 전임 조사관 인력보 강이 시급히 해결해야 하고, 이와 함께 전임 조사관들과 각 부처 파견자들의 기능적 협 업을 통해 공정성과 전문성을 함께 추구해야 한다. 그리고, 옴부즈만제도의 취지와 성 격을 고려하여 수사의 본질적인 부분에 해당하는 민원은 형사사법기관의 구제절차나 판단에 맡기고, 현행 수사구조와 형사절차의 특성을 고려하여 수사관련 고충민원의 경 우 기소 전까지 권익위원회 전문옴부즈만의 고충민원조사가 적시성있게 이루어지고, 조사결과가 실효성을 가질 수 있도록 조직과 권한을 강화해야 한다.
In 2006 Korean government established permanent ombudsman specializing in handling of complaints involving the police and after the reorganization of governmental structure in 2008 it remains in the Anti-Corruption & Civil Rights Commission. Since then Korean Police Ombudsman handles complaints arising from measures taken by police agencies and acts by police officers. And the police ombudsman looks at possible violations of rights and interests or distress caused by actions of police agencies or any irregularities or injustices perpetuated by police officers in the course of conducting their duties. The aim of this study is as followed. First, to review whether Korean Police Ombudsman has been functioning well or not. Second, to analysis other countrys' Police Ombudsman system. Finally, to recognize the problems of Police Ombudsman and propose its improvements.
