범죄피해자보호기금의 재정건전성 개선을 위한 연구

Crime victims directly suffer from physical, material pain, and they also get secondary damages due to psychological, economical aftereffects. Even though they experience harmful events unintentionally, government intervention is generally accepted in that human rights are violated. Therefore, society needs the system that includes comprehensive procedures including criminal law, economic resilience and psychological stability for crime victims. Moreover, due to increasing violent crimes and promoting awareness of human rights for crime victims, 「Crime Victim Protection Act」 became a law in 2005. And in 2010, 「Crime Victims Protection Fund Act」 is enacted. Revenues of crime victims protection fund are bound to the very 6/100 of the enforced fine from the general account under 「Criminal Procedure Act」. But, since it is not sufficient that the amount received from that fixed ratio fine, the reimbursement of the claim, the profits from the operation, the revenues of the fund is about to perish and main sources of the fund have to be diversified. This study gathers various methods of financing, and applies them to Crime Victims Protection fund in Korea. Furthermore, it forecasts the financial stability of each method and practical finance structures and then compares them. Ultimately, the purpose of the study makes policy proposals in order to capture new finance resources. Specifically, there are the raising transferred fine rate, adding the flat-rate implementation, cumulative transfer rate, changing the transfer rate according to type of crime, diversifying the transfer rate according to amount of fine, arrangement of total fine basis financial resource, and the reinforcement of exercising right to indemnity.
