주거권 보장을 위한 주택 관리 법제의 입법 개선방안 - 실내 인테리어 공사를 중심으로 -

주거권은 물리적·사회적 위험으로부터 벗어나 쾌적하고 안정적인 주거환경에서 인간다운 주거생활을 할 권리를 말한다. 주거권은 물리적 실체인 주택을 기초로 보장될 수 있다. 주거권 보장과 관련된 주택은 건설, 공급, 관리로 구분될 수 있는데, 오늘날 주택보급률이 100%를 초과한 상황에서 입주자의 권익보호와 삶의 질 향상 및 공동체의 형성과 같은 관리 분야를 중심으로 주거권을 논의하는 것은 큰 의의가 있다. 주택 관리의 대표적인 수단인 실내 인테리어 공사의 경우 주택 관리 법제에서 공사의 시공 주체 및 요건에 대한 법적 미비로 인한 많은 피해 및 법적 분쟁이 발생하고 있다. 주택의 관리는 종래 사적 자치의 영역으로 인정되었으나, 쾌적하고 안정적인 주거환경 조성을 위하여 공법적 규제가 필요하다. 따라서 주택 관리 법제인 「건설산업기본법」에서 실내 인테리어 공사의 시공 요건을 명확히 규정하고, 「공동주택관리법」에서 실내 인테리어 공사 등 경미한 행위로서 주택내부의 구조물과 설비를 증설하거나 제거하는 행위는 관리주체의 동의를 받게 할 필요가 있다.
