특정무역현안(STC) 현황 및 효과적 대응방안을 위한 연구

Current status and effective countermeasures for STC

연구목적: 본 연구의 목적은 특정무역현안에 대한 현황을 살펴보고 효과적인 대응방안을 강구하기 위한 것이다. 특정무역현안은 WTO에 공지된 신규 또는 시행중인 기술규제가 교역 상대국의 수출에 부정적 영향을 미칠 수 있다고 판단되는 경우 각 회원국은 WTO/TBT 위원회에 공식이의를 제기하여 논의하는 것을 말하는데 원활한 교역을 위해 이에 대한 효과적 대응이 필요하다. 논문구성/논리: 본 연구는 전체 다섯 장으로 구성되어 있다. 첫 번째 장에서는 본 연구의 배경과 목적을 설명하며, 두 번째 장에서는 TBT 관련 분쟁해결에 관한 기존 연구를 살펴보았다. 세 번째 장에서는 국내 대응 사례 분석을, 네 번째 장에서는 IT를 활용한 STC에 대한 효과적 대응방안을 도출하고, 마지막 장에서는 본 연구의 결론을 제시하였다. 결과: 본 연구에서는 특정무역현안의 현황을 살펴보고 최근 국내의 대응 사례 3 건을 구체적으로 살펴보았다. 조사 결과에 따르면 불합리한 무역 조치는 무역 분쟁으로 이어질 수 있고 아국의 교역에 장애가 되기 때문에 이에 대한 신속하고 효과적인 대응방안이 필요하다. 특별히 중소기업의 원활한 교역을 위해 본 연구에서는 IT를 활용한 방법 및 기타 효과적인 STC 대응 방안을 제시하였다. 독창성/가치: 무역 분쟁에 관한 기존의 연구들이 제도의 차이 연구에 그치고 있는 반면, 본 연구는 STC 대응 사례의 정성적 분석을 통해 무역조치에 대한 효과적 대응방안을 모색해 보고자 하였다.

Purpose: The purpose of this paper is to examine current status and suggest effective countermeasures for STC(Specific Trade Concerns). STC refers to raised and discussed issues related to certain technical measures of standards, technical regulations, and conformity assessment procedures; proposed with notification, currently in force, or maintained by other members. It is necessary to be coped with effectively for harmonized trading. Composition/Logic: This paper is composed of five chapters. First chapter explains the background and purpose of this paper. Second chapter analyzes prior studies of dispute settlement related to TBT. Third chapter investigates correspondence cases of STC in korea. Fourth chapter suggests effective countermeasures for STC using IT. Finally fifth chapter draws conclusion of this paper. Findings: This paper analyzes current status and a couple of corresponding cases of STC. The analysis result shows that it is necessary prompt and effective countermeasures for STC because it provide barriers to trade and could lead to trade dispute. Therefore, this paper suggests some effective countermeasures for STC including IT utilization especially for small company. Originality/Value: Previous studies on trade dispute have focused on the difference of system. This paper, however, has the originality and value in that it provides effective countermeasures for STC by analyzing STC cases qualitatively.
