The North Korea Human Rights Act and Human Rights Policy toward North Korea

북한인권 개선은 국제사회의 주요 관심사안이자 통일과 한반도 평화를 위해서 우리 정부가 포기할 수 없는 당위적인 정책과제이다. 유엔제재와 국제인권압력이 북한의 핵포기 목표와 인권개선 목표를 달성할지 여부가 불확실한 가운데 북한인권법안이 여야 합의로 통과되었다. 이제 대북제재를 넘어서 북한내부의 변화를 통한 체제전환의 지렛대를 만들어갈 필요성이 대두하고 있다. 북한인권법은 여야간 정치적 타협의 산물로 여러 가지 쟁점과 후속 보완조치가 필요하다. 향후 대북인권정책은 북한인권법의 제약점을 넘어서 포괄적인 목표와 다양한 수단을 동원할 필요성이 있다. 특히 인권정보의 생산과 확산, 매체에 대한 지원 등이 고려되어야 하며 인권기반 전략적 대북 관여정책이 추진되어야 한다. 북한인권개선은 궁극적으로 북한체제 변화와 북한주민의 인식전환으로 촉구될 수 있다.

The protection and promotion of North Korean human rights is one of the most urgent and normative policy goals for reunification and peace in Korea. The North Korea Human Rights Act was passed by Korea's National Assembly in the midst of harsh international sanctions against North Korea in 2016. It is not clear whether North will give up its nuclear ambitions and adapt international human rights standards, however. A more aggressive policy that pushed for regime change in North Korea could trigger social mobilization and double the impact of international sanctions. The North Korea Human Rights Act needs to be amended and supplemented as it was the result of political bargaining. Human rights policy toward North Korea should set up comprehensive goals and use various means, such as prioritizing production and the spread of human rights information and supporting radio broadcasting. Human rights-based strategic engagement is another policy option. In the long run, the enlightenment of the North Korean people and regime change are key elements in the promotion of human rights in North Korea.
