An Essay on the Directions for Revision of Resident Registration Act

최근의 개인정보 유출사태로 인한 주민등록번호제도 개선방안이 활발히 논의 중인 가운데 2015년 12월 헌법재판소의 주민등록번호변경결정이 이루어짐에 따 라 본격적인 제도개선이 요구되고 있다. 이에 본고는 우리나라 주민등록번호제도 의 역사적 전개과정과 현황을 개관하고, 주민등록번호의 변경과 관련한 기존의 제도개선방안들 및 제19대 국회에서 제안된 다수의 주민등록법 개정안들과 함께 19대 국회 종료 직전 이루어진 주민등록법 개정을 통해 도입된 주민등록번호 변경제도를 검토한 후, 이와 관련한 범위 내에서의 주민등록법 의 바람직한 개정방향을 특히 헌재의 주민등록번호변경결정 내용을 중심으로 검토해 보았다. 우리나라의 주민등록제도는 본래 모든 국민을 효과적으로 관리하고자 하는 행정상의 필요성에 의하여 도입된 측면이 강한 것이 사실이다. 그렇지만 현대사회 에서 행정사무는 과거 야경국가의 그것을 넘어, 국민의 기본권을 보장하기 위해 다양한 영역까지 확장중이기 때문에 이러한 행정사무의 적정ㆍ효율적인 처리는 궁극적으로는 주민생활의 편익을 증진시키기 위한 것으로서, 국민의 기본권을 제 한하는 측면 못지않게 기본권을 보장하고 신장시키는 데에 있어서도 적지 않은 중요성을 가진다 할 것이다. 결론적으로 본 연구는 헌재가 요구한 주민등록번호제도 변경제도의 도입을 전 제로 하는 가운데, 단기적인 개선방안으로는 개인정보보호의 민간영역에서의 활용제한 및 현행 주민등록번호체계의 전면적인 갱신(更新)을 제안하며, 나아가 중 ㆍ장기적인 개선방안으로는 상대적으로 변화의 폭이 적은 대안으로 기존주민등록번호 체제를 대체적으로 유지하는 가운데 발행번호를 도입하는 방안이나 혹은 전면적인 개선안으로서 임의번호체계하의 새로운 관리번호체계와 증발행번호 체계를 도입하는 방안을 제시하였다.

Because of recent Personal Information leakage cases, the issue for reforming resident registration system has actively been under discussion and the request for that reformation has become more practical issue after the decision of Constitutional Court of Korea for allowing ‘Resident Registration Number(hereinafter referred to as “RRN”)’ to be changed in December, 2015. In this context the study gives an overview of the historical development process and the current state of RRN system and examines the existing theoretical solutions for reforming that system and the newly revised Resident Registration Act including the several revised bills of it in 19th National Assembly. It further tries to find a desirable direction for revision of that act relevant to the system for changing RRN as well. As is generally known, our resident registration system was originally introduced to administratively control and manage people but, in these days of administrative nation aiming for welfare state, it can also contribute to proper and efficient handling of administrative tasks to guarantee fundamental rights of people. The study concludes that it is necessary the introduction of the system for changing RRN corresponding the decision of Constitutional Courts. Moreover the study suggests the restriction of using RRN in private sector and the sweeping change of current RRN system as the short term solution and the introduction of identification card-issued number system under current RRN system or new management RRN system based on random numbering with Identification Card-Issued Number system as the mid-long term solution.
